Abstract

ABSTRAK Hadirnya Permenhub Nomor 12 Tahun 2019 tentang pelindungan keselamatan pengguna sepeda motor yang digunakan untuk kepentingan masyarakat menjadi aturan ketentuan persyaratan hingga sikap tegas dan hukuman atas sikap tidak disiplin dan pelayanan buruk yang diberikan oleh ojek online kepada masyarakat selaku konsumen. Namun, nyatanya sejauh ini peraturan tersebut masih belum terimplementasi secara maksimal, karena beberapa pengguna ojek online masih sering menemukan akun pengemudi (driver) yang berbeda dengan identitas aslinya. Sehingga hal ini menjadi sebuah kecemasan dan kekhawatiran penumpang atas keselamatan, keamanan, dan kenyamanan mereka dalam menggunakan jasa transportasi online. Rumusan masalah penelitian ini:(1) Bagaimana Implementasi Peraturan Menteri Perhubungan Pasal 5 ayat 2 (b) Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor yang Digunakan Untuk Kepentingan Masyarakat Pada Dinas Perhubungan Kota Bandar Lampung? (2) Bagaimana Tinjauan Siyāsah Tanfiżiyah Terhadap Implementasi Peraturan Menteri Perhubungan pasal 5 ayat 2 (b) Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor yang Digunakan Untuk Kepentingan Masyarakat? Metode penelitian ini adalah metode kualitatif. Jenis penelitiannya adalah lapangan (field research) dengan sifat penelitian Deskripstif Analisis. Sampel dalam penelitian terdiri dari 2 orang staff Dishub Kota Bandar Lampung, 4 orang Driver Gojek, dan 4 orang konsumen Gojek. Teknik pengumpulan data dilakukan dengan metode wawancara, observasi, dan dokumentasi. Analisa data dilakukan secara bertahap dan berlapis menggunakan teori Fiqh Siyāsah tandfidziyyah. Hasil penelitian ini ialah: (1) Implementasi Pasal 5 ayat 2 (b) Nomor 12 Tahun 2019 Tentang Perlindungan Implementasi Pasal 5 ayat 2 (b) Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor yang Digunakan Untuk Kepentingan Masyarakat Pada Dinas Perhubungan Kota Bandar Lampung sudah berjalan sesuai SOP yang berlaku. Meskipun ada beberapa yang tidak sesuai dengan identitas, namun pihak Gojek dan Dinas Perhubungan tetap menghimbau agar driver-driver tetap mengutamakkann keselamatan, keamanan, dan kenyamanan penumpang. (2) Ditinjau dari Siyāsah Tanfiżiyah bahwa pelaksanaan pasal 5 ayat 2 (b) Permenhub Nomor 12 Tahun 2019 telah memenuhi 3 konsep Siyāsah Tanfiżiyah yakni terlaksananya ketertiban dan kepastian hukum, pertanggung jawaban, dan kemaslahatan masyarakat. Kata Kunci: Keselamatan, Pengguna, Sepeda Motor. ABSTRACT The presence of Permenhub Number 12 of 2019 concerning the protection of the safety of motorcycle users used for the benefit of the community has become a rule of provisions, requirements, and firm attitudes and penalties for undisciplined attitudes and poor service provided by online motorcycle taxis to the community as consumers. However, in fact, so far this regulation has not been implemented optimally, because some online motorcycle taxi users still often find driver accounts that are different from their original identities. So this has become an anxiety and concern for passengers regarding their safety, security, and comfort in using online transportation services. The formulation of the research problem: (1) How is the Implementation of the Regulation of the Minister of Transportation Article 5 paragraph 2 (b) Number 12 of 2019 concerning the Protection of the Safety of Motorcycle Users Used for the Benefit of the Community at the Bandar Lampung City Transportation Service? (2) How is the Siyāsah Tanfiżiyah Review of the Implementation of the Regulation of the Minister of Transportation Article 5 paragraph 2 (b) Number 12 of 2019 concerning the Protection of the Safety of Motorcycle Users Used for the Interest of the Community? This research method is a qualitative method. The type of research is field research with a descriptive analytical research nature. The sample in the study consisted of 2 staff of the Bandar Lampung City Transportation Agency, 4 Gojek Drivers, and 4 Gojek consumers. Data collection techniques were carried out using interview, observation, and documentation methods. Data analysis was carried out in stages and in layers using the Fiqh Siyāsah tandfidziyyah theory. The results of this study are: (1) Implementation of Article 5 paragraph 2 (b) Number 12 of 2019 concerning the Protection of the Implementation of Article 5 paragraph 2 (b) Number 12 of 2019 concerning the Protection of the Safety of Motorcycle Users Used for the Interest of the Community at the Bandar Lampung City Transportation Agency has been running in accordance with the applicable SOP. Although there are some that do not match the identity, Gojek and the Transportation Agency continue to appeal to drivers to prioritize passenger safety, security, and comfort. (2) Reviewed from the Siyāsah Tanfiżiyah, the implementation of Article 5 paragraph 2 (b) of Permenhub Number 12 of 2019 has fulfilled the 3 concepts of Siyāsah Tanfiżiyah, namely the implementation of order and legal certainty, accountability, and public welfare.
