Abstract

ABSTRAK Polusi yang terjadi akibat aktivitas perusahaan seperti terjadi polusi udara di Way Lunik Kecamatan Panjang akibat aktivitas gudang batu bara jika dibiarkan akan mengakibatkan udara sekitar menjadi kotor sehingga dapat menjadi wabah penyakit bagi masyarakat. Pasal 6 Peraturan Daerah Kota Bandar Lampung Nomor 6 Tahun 2020 Tentang Kesehatan Lingkungan adalah ketentuan spesifik mengenai tanggung jawab masyarakat dan pemerintah dalam menjaga kesehatan lingkungan untuk menciptakan lingkungan yang sehat dan nyaman. Berdasarkan latar belakang di atas peneliti tertarik untuk melakukan penelitian dengan judul “Analisis Fiqh Siyāsah Tanfiẓiyah Terhadap Implementasi Pasal 6 Peraturan Daerah Kota Bandar Lampung Nomor 6 Tahun 2020 Tentang Kesehatan Lingkungan (Studi di Dinas Kesehatan Kota Bandar Lampung).” Rumusan masalah dalam penelitian ini adalah (1) Bagaimana implementasi Pasal 6 Peraturan Daerah Kota Bandar Lampung Nomor 6 Tahun 2020 Tentang Kesehatan Lingkungan oleh Dinas Kesehatan Kota Bandar Lampung? (2) Bagaimana analisis fiqh siyāsah tanfiẓiyah terhadap implementasi Pasal 6 Peraturan Daerah Kota Bandar Lampung Nomor 6 Tahun 2020 Tentang Kesehatan Lingkungan oleh Dinas Kesehatan Kota Bandar Lampung? Penelitian ini termasuk penelitian lapangan (field research). Informan dalam penelitian ini sebanyak 8 orang yaitu 1 orang Sekretaris Dinas Kesehatan Kota Bandar Lampung, 1 orang Staff Bidang Kesehatan Masyarakat Dinas Kesehatan Kota Bandar Lampung, 1 orang Lurah Way Lunik Kecamatan Panjang Kota Bandar Lampung, 1 orang Ketua RT 04 Kelurahan Way Lunik Kecamatan Panjang Kota Bandar Lampung, dan 4 orang masyarakat Kelurahan Way Lunik Kecamatan Panjang Kota Bandar Lampung. Teknik analisa data dengan reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian mengemukakan bahwa Pasal 6 Peraturan Daerah Kota Bandar Lampung Nomor 6 Tahun 2020 Tentang Kesehatan Lingkungan oleh Dinas Kesehatan Kota Bandar Lampung belum maksimal. Hal ini dibuktikan kurangnya regulasi yang ketat terhadap pengelolaan limbah dan emisi batu bara. Selain itu, lemahnya penegakan hukum terhadap pelanggaran lingkungan memperburuk situasi. Implementasi Pasal 6 Peraturan Daerah Kota Bandar Lampung Nomor 6 Tahun 2020 Tentang Kesehatan Lingkungan oleh Dinas Kesehatan Kota Bandar Lampung belum sesuai dengan prinsip fiqh siyāsah tanfiẓiyah sebagaimana yang tercantum dalam QS. An-Nisa ayat 58. Hal ini dikarenakan pelaksanaan kebijakan tersebut masih minim pengawasan secara konsisten dan evaluasi berkala yang mengacu pada tujuan syariah (maqāṣid al-sharī‘ah) dalam menjaga kesehatan masyarakat secara menyeluruh. ABSTRACT Pollution caused by company activities such as air pollution in Way Lunik, Panjang District due to coal warehouse activities if left unchecked will cause the surrounding air to become dirty so that it can become an epidemic for the community. The Bandar Lampung City Health Office, one of the technical institutions under the Lampung Provincial Government, has a very strategic role in achieving the goals of the Lampung Provincial Government. Article 6 of the Bandar Lampung City Regional Regulation Number 6 of 2020 concerning Environmental Health is a specific provision regarding the responsibility of the community and government in maintaining environmental health to create a healthy and comfortable environment. Based on the background above, the researcher is interested in conducting a study entitled "Analysis of Fiqh Siyāsah Tanfiẓiyah on the Implementation of Article 6 of the Bandar Lampung City Regional Regulation Number 6 of 2020 concerning Environmental Health (Study at the Bandar Lampung City Health Office)." Formulation (1) How is the implementation of Article 6 of Bandar Lampung City Regional Regulation Number 6 of 2020 concerning Environmental Health by the Bandar Lampung City Health Office? (2) How is the analysis of fiqh siyāsah tanfiẓiyah on the implementation of Article 6 of Bandar Lampung City Regional Regulation Number 6 of 2020 concerning Environmental Health by the Bandar Lampung City Health Office? This study includes field research. The informants in this study were 8 people, namely 1 Secretary of the Bandar Lampung City Health Office, 1 Public Health Staff of the Bandar Lampung City Health Office, 1 Head of Way Lunik Village, Panjang District, Bandar Lampung City, 1 Head of RT 04, Way Lunik Village, Panjang District, Bandar Lampung City, and 4 people from the Way Lunik Village, Panjang District, Bandar Lampung City. Data analysis techniques with data reduction, data presentation, and drawing conclusions. The results of the study suggest that Article 6 of the Bandar Lampung City Regional Regulation Number 6 of 2020 concerning Environmental Health by the Bandar Lampung City Health Office has not been optimal. This is evidenced by the lack of strict regulations on waste management and coal emissions. In addition, weak law enforcement against environmental violations worsens the situation. The implementation of Article 6 of the Bandar Lampung City Regional Regulation Number 6 of 2020 concerning Environmental Health by the Bandar Lampung City Health Office is not in accordance with the principles of fiqh siyāsah tanfiẓiyah as stated in QS. An Nisa verse 58. This is because the implementation of the policy still lacks consistent supervision and periodic evaluation that refers to the objectives of sharia (maqāṣid al-sharī„ah) in maintaining public health as a whole.
