Abstract

ABSTRAK Pungutan Liar merupakan memungut sesuatu tidak berdasarkan atas suatu aturan (hukum). Pungutan Liar juga dapat diartikan segagai suatu perbuatan yang dilakukan setiap orang dengan tujuan menguntungkan dirinya sendiri, orang lain, dan/atau korporasi secara melawan hukum atau dengan menyalahgunakan wewenangnya dengan cara meminta/ memaksa seseorang untuk memberikan sesuatu, membayar, atau menerima pembayaran dengan potongan, atau untuk mengerjakan secara tidak legal atau tidak sesuai ketentuan peraturan perundang-undangan. Penelitian ini ingin menjawab dua persoalan 1) Peran Satuan Polisi Pamong Praja Pada Implemetasi Pasal 8 Peraturan Daerah Kabupaten Lampung Tengah Nomor 16 Tahun 2018 Tentang Ketertiban Umum Dan Ketentraman Masyarakat Studi di Kantor Satuan Polisi Pamong Praja Kabupaten Lampung Tengah dan 2) Perspektif Fiqh Siya>>sah Tanfidz} }iyyah Terhadap Peran Satuan Polisi Pamong Praja Pada Implementasi Pasal 8 Peraturan Daerah Kabupaten Lampung Tengah Nomor 16 Tahun 2018 Tentang Ketertiban Umum Dan Ketentraman Masyarakat di Kantor Satuan Polisi Pamong Praja Kabupaten Lampung Tengah. Metode yang digunakan adalah metode kualitatif karena penelitian kualitatif adalah penelitian tentang riset yang bersifat deskriptif yang cenderung mengunakan analisis, serta proses dan makna lebih diutamakan dalam penelitian kualitatif. Dan penelitian ini merupakan penelitian lapangan (Field Research). Penelitian lapangan dilakukan dengan mengkaji data yang bersumber dari lokasi penelitian. Kesimpulan dalam penelitian ini pertama, Peran Satuan Polisi Pamong Praja Pada Implementasi Pasal 8 Peraturan Daerah Kabupaten Lampung Tengah Nomor 16 Tahun 2018 Tentang Ketertiban Umum Dan Ketentraman Masyarakat sudah terlaksana sebagaimana mestinya. Namun, faktor yang mempengaruhi masih terjadinya kasus pungutan liar ini adalah tidak adanya sosialisasi bagi masyarakat mengenai pencegahan pungutan liar untuk menumbuhkan kesadaran masyarakat. Ekonomi pun menjadi salah satu faktor penyebab mengapa tindakan pungutan liar masih terus terjadi. Kedua, Analisis fiqh siya>sah terhadap Peran Satuan Polisi Pamong Praja Pada Implementasi Pasal 8 Peraturan Daerah Kabupaten Lampung Tengah Nomor 16 Tahun 2018 Tentang Ketertiban Umum Dan Ketentraman Masyarakat sebagai unsur pelaksana dari pemerintahan kabupaten dan dalam kaitannya dengan fiqh siya> >sah bahwa peran Satuan Polisi Pamong Praja pada impelentasi Peraturan Daerah sudah sesuai dengan fiqh siya>>sah tanfidz}iyyah. Hal ini Karena kebijakan tentang menjaga ketertiban umum dan ketentraman masyarakat sudah dilaksanakan secara optimal. Kata Kunci: Peran, Peraturan Daerah, Fiqh Siya>sah Tanfidz}iyyah. ABSTRACT Illegal Levy is the collection of something that is not based on a rule (law). Illegal Levy can also be interpreted as an act done by every person with the aim of benefiting himself, others, and/or the corporation unlawfully or by abusing his authority by asking/forcing someone to give something, pay, or receive payment in deductions, or to work illegally or not in accordance with the provisions of laws and regulations. This study wants to answer two questions: 1) The Role of the Pamong Praja Police Unit in the Implementation of Article 8 of the Central Lampung Regency Regional Regulation Number 16 of 2018 concerning Public Order and Public Peace, Study at the Office of the Central Lampung Regency Pamong Praja Police Unit, and 2) Fiqh Siya>>sah Tanfidz}}iyyah's Perspective on the Role of the Pamong Praja Police Unit in the Implementation of Article 8 of the Central Lampung Regency Regional Regulation Number 16 of 2018 concerning Public Order and Public Peace at the Office of the Pamong Praja Police Unit, Central Lampung Regency. The method used is a qualitative method because qualitative research is research on descriptive research that tends to use analysis, and the process and meaning are prioritized in qualitative research. And this research is a field research. Field research was carried out by reviewing data sourced from the research location The conclusion in this study is first, the Role of the Civil Service Police Unit in the Implementation of Article 8 of the Regional Regulation of Central Lampung Regency Number 16 of 2018 Concerning Public Order and Public Order has been implemented as it should. However, the factor that influences the ongoing cases of extortion is the absence of socialization for the community regarding the prevention of extortion to raise public awareness. The economy is also one of the factors causing extortion to continue to occur. Second, the analysis of fiqh siya>sah on the Role of the Civil Service Police Unit in the Implementation of Article 8 of the Regional Regulation of Central Lampung Regency Number 16 of 2018 Concerning Public Order and Public Order as an implementing element of the district government and in relation to fiqh siya>>sah that the role of the Civil Service Police Unit in the implementation of Regional Regulations is in accordance with fiqh siya>>sah tanfidz}iyyah.
