Abstract
ABSTRAK Perceraian sering terjadi akibat ketidakharmonisan dalam rumah tangga. Dalam Hukum Islam talak adalah hak suami untuk menceraikan istrinya, namun harus memenuhi syarat salah satunya adalah pemberitahuan kepada istri. Talak tanpa sepengetahuan istri, meskipun secara formal mungkin telah diterima oleh pihak pengadilan, dapat menimbulkan permasalahan hukum terkait dengan hak-hak istri yang tidak terlindungi dengan baik. Penelitian ini berfokus pada pengabulan talak tanpa sepengetahuan istri yang terjadi di Kecamatan Natar, Kabupaten Lampung Selatan, dengan melihat bagaimana hal ini dipandang dari sudut pandang hukum Islam dan hukum positif di Indonesia. Jenis penelitian ini adalah penelitian lapangan (Field Research) yang bersifat deskriptif kualitatif. Pengumpulan data melalui dokumentasi dan wawancara dengan informan. Data dianalisis secara kualitatif melalui kajian pustaka, termasuk Undang-Undang Nomor 1 Tahun 1974. Dan teori yang digunakan adalah hukum Islam dan hukum positif. Hasil dan simpulan penelitian ini, dalam hukum Islam talak tanpa sepengetahuan istri tetap dianggap sah asalkan memenuhi syarat dan rukun yang ditetapkan. Namun, dalam hukum positif Indonesia, praktik tersebut melanggar prinsip perlindungan hak-hak istri yang diatur dalam Undang-Undang Nomor 1 Tahun 1974 dan Kompilasi Hukum Islam. Praktik talak tanpa sepengetahuan istri yang terjadi di Desa Natar Kecamatan Natar Kabupaten lampung selatan, menimbulkan ketidakadilan, khususnya terkait pemenuhan hak-hak istri seperti nafkah, hak asuh anak, dan pembagian harta bersama. Kata Kunci : Perceraian, Talak, Hukum Islam, Hukum Positif, Talak Tanpa Sepengetahuan Istri, Perkawinan, Hak Istri. ABSTRACT Divorce often occurs due to disharmony in the household. In Islamic law, divorce is the husband's right to divorce his wife, but one of the conditions must be fulfilled, one of which is notification to the wife. Divorce without the wife's knowledge, even though it may have been formally accepted by the court, can give rise to legal problems related to the wife's rights not being properly protected. This research focuses on the granting of divorce without the wife's knowledge which occurred in Natar District, South Lampung Regency, by looking at how this is viewed from the perspective of Islamic law and positive law in Indonesia. This type of research is field research (Field Research) which is descriptive qualitative. Data collection through documentation and interviews with informants. Data is analyzed qualitatively through literature review, including Law Number 1 of 1974. And the theories used are Islamic law and positive law. The results and conclusions of this research, in Islamic law, divorce without the wife's knowledge is still considered valid as long as it fulfills the specified conditions and harmony. However, in Indonesian positive law, this practice violates the principle of protecting the rights of wives as regulated in Law Number 1 of 1974 and the Compilation of Islamic Law. The practice of talak without the wife's knowledge, which occurred in Natar Village, Natar District, South Lampung Regency, gave rise to injustice, especially regarding the fulfillment of the wife's rights such as maintenance, child custody and the division of joint property.
