Abstract

ABSTRAK Nelayan merupakan individu ataupun kelompok yang mata pencahariannya menangkap ikan. Pekerjaan sebagai nelayan sangat beresiko karena harus bersentuhan dengan gelombang air laut. Berdasarkan Peraturan Daerah Provinsi Lampung Nomor 8 Tahun 2019 tentang Perlindungan dan Pemberdayaan Nelayan Pembudidaya Ikan dan Petambak Garam, bahwa nelayan memiliki hak penuh atas perlindungan terhadap dirinya saat mencari ikan. Adapun permasalahan dalam penelitian ini adalah (1) Bagaimana implementasi Peraturan Daerah Provinsi Lampung Nomor 8 Tahun 2019 Tentang Perlindungan dan Pemberdayaan Nelayan Pembudidaya Ikan dan Petambak Garam?, (2) Bagaimana Tinjauan Fiqh Siyasah Terhadap Implementasi Peraturan Daerah Provinsi Lampung Nomor 8 Tahun 2019 Tentang Perlindungan dan Pemberdayaan Nelayan Pembudidaya Ikan dan Petambak Garam?. Penelitian ini bertujuan untuk mengetahui implementasi Peraturan Daerah Provinsi Lampung Nomor 8 Tahun 2019 Pasal 29 dan mengetahui tinjauan Fiqh Siyasah Tanfidziyyah terhadap implementasi Peraturan Daerah Provinsi Lampung Nomor 8 tahun 2019 tentang Perlindungan dan Pemberdayaan Nelayan Pembudidaya Ikan dan Petambak Garam. Jenis penelitian ini adalah dengan penelitian lapangan (field research). Adapun teknik pengumpulan data dilakukan dengan purposive sampling dari total nelayan 375 orang untuk melihat bagaimana perkembangannya. Dalam penelitian ini wawancara dilakukan kepada 2 aparatur dari Dinas Kelautan dan Perikanan Provinsi Lampung,7 nelayan Teluk Betung, 1 isteri nelayan. Hasil dari penelitian ini dalam Implementasi Peraturan Daerah Provinsi Lampung Nomor 8 Tahun 2019 Tentang Perlindungan Terhadap Nelayan Pembudidaya Ikan dan Petambak Garam di Pulau Pasaran Kota Bandar Lampung adalah masih belum terimplementasikan dengan baik karena masih banyaknya nelayan yang tidak mendapatkan hak perlindungannya, salah satu yang menjadi faktornya adalah adanya syarat tertentu bagi setiap nelayan agar mempunyai surat izin kelayakan berlayar sehingga tidak bisa mendapatkan pertanggung jawaban yang penuh oleh Dinas Kelautan dan Perikanan Provinsi Lampung. Hal itu tidak sesuai dengan isi Peraturan Daerah Provinsi Lampung Nomor 8 Tahun 2019 Passal 29, karena dalam isi pasal tersebut tidak menjelaskan bahwa nelayan yang berhak dilindungi hanya nelayan yang sudah memiliki Surat izin kelayakan berlayar saja. . Hal itu juga tidak sesuai dengan prinsip fiqh siyasah tanfidziyyah sebagaimana Dinas Kelautan dan Perikanan Provinsi Lampung tidak amanah dan tidak adil dalam melindungi masyarakat nelayan khususnya di Pulau Pasaran Kota Bandar Lampung. Work as a fisherman is very risky because it has to come into contact with the waves of sea water. Based on Lampung Provincial Regulation Number 8 of 2019 concerning the Protection and Empowerment of Fish Cultivators and Salt Farmers, fishermen have full rights to protection for themselves when looking for fish. The problems in this study are (1) How is the implementation of Lampung Provincial Regional Regulation Number 8 of 2019 concerning the Protection and Empowerment of Fish Cultivators and Salt Farmers?, (2) What is the review of Fiqh Siyasah on the implementation of Lampung Provincial Regional Regulation Number 8 of 2019 concerning the Protection and Empowerment of Fish Farmers and Salt Farmers?. This study aims to find out the implementation of Lampung Provincial Regional Regulation Number 8 of 2019 Article 29 and to find out the review of Fiqh Siyasah Tanfidziyyah to the implementation of Lampung Provincial Regional Regulation Number 8 of 2019 concerning the Protection and Empowerment of Fish Farmers and Salt Farmers. This type of research is field research. The data collection technique was carried out by purposive sampling from a total of 375 fishermen to see how the development was. In this study, interviews were conducted with 2 officials from the Lampung Provincial Marine and Fisheries Service, 7 Teluk Betung fishermen, 1 fisherman's wife. The results of this study in the Implementation of Lampung Provincial Regulation Number 8 of 2019 Concerning Protection of Fishermen, Fish Farmers and Salt Farmers on Pasaran Island, Bandar Lampung City are still not implemented properly because there are still many fishermen who do not get their protection rights, one of the factors is the existence of certain requirements for each fisherman to have a sailing permit so that they cannot get full accountability from the Lampung Provincial Marine and Fisheries Service. This is not in accordance with the contents of Lampung Provincial Regional Regulation Number 8 of 2019 Article 29, because the contents of the article do not explain that fishermen who have the right to be protected are only fishermen who already have a Sailing Permit. It is also not in accordance with the principles of fiqh siyasah tanfidziyyah as the Marine and Fisheries Service of Lampung Province is not trustworthy and unfair in protecting the fishing community, especially on Pasar Island, Bandar Lampung City.
