Abstract

ABSTRAK UU No. 1 Tahun 2014 tentang ASN mengatur pembentukan lembaga independen yang bernama Komisi Aparatur Sipil Negara (KASN). KASN mempunyai wewenang, tugas, dan fungsi pada pengawasan sistem merit dalam manajemen ASN. Namun, 31 Oktober 2023 terdapat Revisi UU ASN menjadi UU No. 20 Tahun 2023. Revisi UU ASN menghapus keberadaan KASN dan menyerahkan wewenang, tugas, dan fungsinya kepada kementerian/lembaga lain. Penelitian ini bertujuan untuk melihat pentingnya lembaga pengawas ASN dan untuk mengetahui sistem pengawasan serta dampak dari perpindahan wewenang, tugas, dan fungsinya. Selain itu, penelitian ini ingin melihat penghapusan KASN dari perspektif fiqh siyāsah. Penelitian ini merupakan penelitian hukum normatif yang menggunakan data sekunder berupa bahan hukum primer dan bahan hukum sekunder. Penelitian menemukan pengawasan sistem merit sangat penting, karena dapat memengaruhi peringkat Indonesia dalam Government Effectiveness Index (GEI) yang membantu Indonesia keluar dari kategori negara berpenghasilan menengah bawah, menuju menengah atas/tinggi. Penelitian menemukan wewenang, tugas, dan fungsi KASN selanjutnya diberikan kepada BKN. Sistem pengawasan tetap sama, tapi terdapat inovasi mengenai digitalisasi penangan perkara netralitas dalam pemilu. Selain itu, Penghapusan KASN melalui Revisi UU ASN sangat minim partisipasi dari para pihak yang memiliki pengetahuan tentang penguatan KASN. Minimnya partisipasi tidak sesuai dengan prinsip musyawarah yang ada dalam prinsip fiqh siyāsah. ABSTRACT Law No. 1 of 2014 concerning ASN regulates the establishment of an independent institution called the State Civil Apparatus Commission (KASN). KASN has the authority, duties, and functions in overseeing the merit system in ASN management. However, on October 31, 2023, there was a revision of the ASN Law into Law No. 2023. The revision of the ASN Law abolishes the existence of KASN and transfers its authority, duties, and functions to other ministries/agencies. This research aims to examine the importance of the ASN supervisory agency and to understand the supervision system as well as the impact of the transfer of its authority, duties, and functions. Additionally, this research aims to examine the abolition of KASN from the perspective of fiqh siyāsah. This research is a normative legal study that uses secondary data in the form of primary legal materials and secondary legal materials. The research found that monitoring the merit system is very important, as it can affect Indonesia's ranking in the Government Effectiveness Index (GEI), helping Indonesia move from the lower-middle-income category to the upper middle/high-income category. The research found that the authority, duties, and functions of KASN were subsequently transferred to BKN. The supervision system remains the same, but there is an innovation regarding the digitalization of handling neutrality cases in elections. Moreover, the abolition of KASN through the Revision of the ASN Law had very minimal participation from parties knowledgeable about strengthening KASN. The lack of participation does not align with the deliberative principle found in the principles of fiqh siyāsah.
