Abstract

ABSTRAK Peraturan Menteri Agraria dan Tata Ruang / Kepala Badan Pertahanan Nasional Republik Indonesia Nomor 1 Tahun 2021 tentang Sertipikat Elektronik tersebut nantinya tiap-tiap individu pemilik hak atas tanah diharapkan tidak lagi memegang dokumen kertas (analog, fisik, manual) lagi, akan tetapi semua sudah beralih ke dokumen elektronik (el sertipikat). Rumusan masalah dalam penelitian ini adalah bagaimana implementasi Peraturan Menteri Agraria Dan Tata Ruang/ Kepala Badan Pertanahan Republik Indonesia Nomor 1 Tahun 2021 Tentang Sertipikat Elektronik? dan bagaimana pandangan fiqh siyasah terhadap Peraturan Menteri Agraria Dan Tata Ruang / Kepala Badan Pertanahan Republik Indonesia Nomor 1 Tahun 2021 Tentang Sertipikat Elektronik?. Tujuan penlitian ini adalah untuk mengetahui dan menganalisis implementasi Peraturan Menteri Agraria Dan Tata Ruang / Kepala Badan Pertanahan Republik Indonesia Nomor 1 Tahun 2021 Tentang Sertipikat Elektronik, dan untuk mengetahui dan menganalisis pandangan fiqh siyasah terhadap Peraturan Menteri Agraria Dan Tata Ruang / Kepala Badan Pertanahan Republik Indonesia Nomor 1 Tahun 2021 Tentang Sertipikat Elektronik. Penelitian yang digunakan dalam penulisan skripsi ini bersifat deskriptif (menggambarkan) analisis.Jenis penelitian ini merupakan penelitian lapangan (field research). Populasi dari penelitian ini adalah 21 pegawai dan pengunjung di Kantor Pertanahan di Kotabumi. Sampel dalam penelitian ini adalah sebanyak 6 orang. 2 Staff Pelayanan dan 4 Pengunjung orang tua atau lansia pendaftaran sertipikat elektronik di Kantor Pertanahan Kotabumi. Hasil penelitian dalam penelitian ini adalah Implementasi Peraturan Menteri Agraria Dan Tata Ruang / Kepala Badan Pertanahan Republik Indonesia Nomor 1 Tahun 2021 Tentang Sertipikat Elektronik di Kantor Pertanahan Kotabumi belum melaksanakan peraturan tersebut dengan baik di mana lansia atau orang tua masih merasa kurang memahami mengenai sertipikat elektronik. Berdasarkan pandangan fiqih siyasah, Peraturan Menteri Agraria Nomor 1 Tahun 2021 tentang Sertipikat Elektronik sejalan dengan siyasah tanfidziyyah adalah bagian fiqh siyasah yang membahas masalah pelaksanaan perundang-undangan Negara yang sejalan dengan prinsip profesionalisme. Kata Kunci : Fiqh Siyasah, Pelayanan, Sertipikat Elektronik. ABSTRACT The Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 1 of 2021 concerning Electronic Certificates is expected to ensure that each individual land rights holder no longer holds paper documents (analog, physical, manual), but instead has transitioned to electronic documents. (el-sertipikat). The problem formulation in this research is how the implementation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 1 of 2021 on Electronic Certificates? and how the perspective of fiqh siyasah on the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 1 of 2021 on Electronic Certificates? The objective of this research is to understand and analyze the implementation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 1 of 2021 on Electronic Certificates, and to understand and analyze the perspective of fiqh siyasah on the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 1 of 2021 on Electronic Certificates. The research used in the writing of this thesis is of a descriptive (illustrative) analysis nature.This type of research is field research. (field research). The population of this study consists of 21 employees and visitors at the Land Office in Kotabumi. The sample in this study consists of 6 people: 2 service staff and 4 elderly visitors registering for electronic certificates at the Kotabumi Land Office. The results of this study indicate that the implementation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Regulation Number 1 of 2021 on Electronic Certificates at the Kotabumi Land Office has not been carried out well, as the elderly or senior citizens still feel they do not fully understand electronic certificates. Based on the perspective of fiqh siyasah, the Minister of Agrarian Affairs Regulation Number 1 of 2021 concerning Electronic Certificates aligns with siyasah tanfidziyyah, which is a part of fiqh siyasah that discusses the implementation of state legislation in accordance with the principle of professionalism.
