Abstract

ABSTRAK Kerja sama bagi hasil dalam muamalah adalah sebuah hubungan manusia dalam interaksi sosial yang saling tolong menolong dalam kehidupan bermasyarakat, seperti yang terjadi pada pengelolaan budidaya jamur tiram di Desa Wates Timur Kecamatan Gadingrejo Kabupaten Pringsewu, terjadi perubahan pada ketentuan pembagian hasil tanpa adanya kesepakatan salah satu pihak. Sedangkan ketentuan tersebut tidak pernah dicantumkan dalam perjanjian awal. Perjanjian tersebut disanggupi oleh kedua belah pihak tanpa adanya paksaan. Perjanjian atau akad yang dilakukan hanya secara lisan tanpa adanya surat perjanjian tertulis dan tanpa adanya saksi. Permasalahan dalam penelitian ini adalah bagaimana praktik kerja sama bagi hasil pengelolaan budidaya jamur tiram antara Pemodal dengan Pengelola di Desa Wates Timur Kecamatan Gadingrejo Kabupaten Pringsewu, serta bagaimana Perspektif Hukum Ekonomi Syariah terhadap praktik kerja sama bagi hasil pengelolaan budidaya jamur tiram antara Pemodal dan Pengelola di Desa Wates Timur Kecamatan Gadingrejo, Kabupaten Pringsewu. Tujuan dari Penelitian ini adalah untuk mengetahui praktik kerja sama bagi hasil pengelolaan budidaya jamur tiram antara Pemodal dengan Pengelola di Desa Wates Timur Kecamatan Gadingrejo Kabupaten Pringsewu dan untuk mengetahui Perspektif Hukum Ekonomi Syariah terhadap praktik kerja sama bagi hasil pengelolaan budidaya jamur tiram antara Pemodal dan Pengelola di Desa Wates Timur Kecamatan Gadingrejo Kabupaten Pringsewu. Penelitian ini merupakan penelitian lapangan (Field Research). Sumber data yang Penulis gunakan terdiri dari sumber data primer dan sumber data sekunder. Setelah data terkumpul Penulis akan melakukan analisa dengan menggunakan metode kualitatif deskriptif. Praktik kerja sama bagi hasil yang dilakukan pada pengelolaan budidaya jamur tiram di Desa Wates Timur Kecamatan Gadingrejo Kabupaten Pringsewu ini tidak seperti praktik yang terjadi pada umumnya. Sebab akad dilakukan secara lisan saja dan tanpa adanya bukti tertulis. Pada perjanjian awal disebutkan pembagian hasil 50%:50%, tetapi setelah pengelolaan dilakukan hasil yang dibagikan tidak sesuai dengan perjanjian awal. Perspektif Hukum Ekonomi Syariah Terhadap Praktik Kerja Sama Bagi Hasil Pengelolaan Budidaya Jamur Tiram tidak sesuai dengan rukun dan syarat mud{a>rabah yang telah ditentukan karena adanya kecacatan dalam berakad. Maka perjanjian akad kerja sama bagi hasil pada pengelolaan budidaya jamur tiram di Desa Wates Timur Kecamatan Gadingrejo Kabupaten Pringsewu ini belum sesuai dengan hukum Islam. ABSTRACT Profit-sharing cooperation in muamalah is a human relationship in social interaction that helps each other in community life, as happened in the management of oyster mushroom cultivation in Wates Timur Village, Gadingrejo District, Pringsewu Regency, there was a change in the provisions of profit sharing without any agreement from one of the parties. While these provisions were never included in the initial agreement. The agreement was agreed to by both parties without any coercion. The agreement or contract that was made was only verbally without any written agreement and without any witnesses. The problem in this research is how to practice cooperation in sharing the results of managing oyster mushroom cultivation between Investors and Managers in Wates Timur Village, Gadingrejo District, Pringsewu Regency, as well as what is the Sharia Economic Law Perspective on the practice of cooperation in sharing the results of managing oyster mushroom cultivation between Investors and Managers in the Village East Wates, Gadingrejo District, Pringsewu Regency. The aim of this research is to determine the practice of cooperation in sharing the results of oyster mushroom cultivation between Investors and Managers in Wates Timur Village, Gadingrejo District, Pringsewu Regency and to find out the Sharia Economic Law Perspective on the practice of cooperation in sharing the results of managing oyster mushroom cultivation between Investors and Managers in East Wates Village, Gadingrejo District, Pringsewu Regency. This research is field research. The data sources that the author uses consist of primary data sources and secondary data sources. After the data is collected, the author will carry out analysis using descriptive qualitative methods. The practice of profit sharing cooperation carried out in the management of oyster mushroom cultivation in East Wates Village, Gadingrejo District, Pringsewu Regency is not like the practice that occurs in general. Because the contract was carried out verbally and without written evidence. In the initial agreement, it was stated that the results were divided 50%:50%, but after the management was carried out, the results distributed were not in accordance with the initial agreement. Sharia Economic Law Perspective on the Practice of Profit Sharing Cooperation in Management of Oyster Mushroom Cultivation is not in accordance with the pillars and conditions of Mud{a>rabah that have been determined due to defects in the contract. So the production sharing cooperation agreement for the management of oyster mushroom cultivation in East Wates Village, Gadingrejo District, Pringsewu Regency is not in accordance with Islamic law.
