Abstract

ABSTRAK Penelitian ini dilatarbelakangi oleh beberapa sebab diantaranya adalah terjadi over kredit rumah antar nasabah tanpa sepengetahuan dari pihak bank sebagai kreditur. Dalam hal ini nasabah pengambil kredit menjual rumah kepada nasabah pembeli dan tidak meneruskan angsuran yang kemudian angsuran tersebut diteruskan oleh nasabah pembeli. Hal ini dilakukan karena beranggapan over kredit di bawah tangan atau tanpa sepengetahuan bank lebih mudah dalam proses pengalihannya. Pengalihan semacam ini yang dilakukan para debitur tidak lah memenuhi rukun dan syarat salah satunya yaitu syarat shighat yang mana muhal tidak berakad dengan muhil, yang berakad dalam over kredit di bawah tangan adalah pihak muhil dengan muhal’alaih. Banyak hal yang menyalahi aturan baik dari segi hukum Islam dari pelaksanaan over kredit di bawah tangan. Selain itu pihak muhil sebagai pihak yang mempunyai hutang kepada bank di awal dapat terkena pasal pidana maupun perdata dikarenakan perbuatannya tersebut. Selain itu pihak muhal’alaih juga dapat terkena pasal pidana. Adapun rumusan masalah dalam skripsi ini adalah. Bagaimana proses over kredit rumah subsidi di Perumahan Pesona Natar Residence dan Bagaimana Tinjauan Hukum Ekonomi Syariah terhadap over kredit yang dilakukan di bawah tangan,Penelitian ini bertujuan untuk mengetahui proses over kredit dengan benar menurut ketentuan yang ada di suatu bank serta analisis hukum Islam dan hukum positif terhadap praktek over kredit yang dilakukan di bawah tangan. Jenis penelitian dalam penulisan skripsi ini adalah penelitian lapangan (field Research) yang bersifat deskriptif. Data yang berupa keterangan yang diperoleh langsung melalui wawancara perorangan yang merupakan 2 orang pembeli dan penjual Teknik sampling yang digunakan penulis dalam penelitian skripsi ini adalah informan penelitian. Adapun pengumpulan data yang dilakukan melalui tiga teknik, yaitu Wawancara, Observasi, dan Dokumentasi. Hasil penelitian ini yaitu proses take over yang dilakukan oleh nasbaah atau debitur secara dibawah tangan jika ditinjau dari hukum ekonomi syariah tidak memenuhi syarat dan rukun, baik dari segi syarat dan rukun hawalah maupun syarat dan rukun murabahah. Karena pada dasarnya akad atau transaksi antara nasabah penjual dengan nasabah pembeli mereka sama-sama ridha (rela) namun dari pihak bank (muhtal) mereka tidak mengetahui dan belum tentu pula mereka meridlai transaksi atau akad tersebut. Dalam hal ini hutang yang dialihkan dari nasabah penjual (muhil) kepada nasabah pembeli (muhal’alaih) tidaklah sah menurut hukum Islam. Kata kunci : Ḥiwālah, Hukum Ekonomi Syariah, over kredit. ABSTRACT his research was motivated by several reasons, including the occurrence of over-credit for homes among customers without the knowledge of the bank as the creditor. In this case, the credit-taking customer sells the house to the buyer customer and does not continue the installments, which are then passed on by the buyer customer. This is done because they assume that over-credit under the hands of or without the bank's knowledge is easier in the transfer process. This kind of transfer carried out by debtors does not fulfill the pillars and conditions, one of which is the shighat condition, where the muhal does not enter into an agreement with the muhil, the one who contracts the over-credit under the hand is the muhil and the muhal'alaih. There are many things that violate the rules both in terms of Islamic law and the implementation of over-credit under the hands. Apart from that, the muhil party, as the party who has a debt to the bank in the first place, can be subject to criminal or civil law because of his actions. Apart from that, the muhal'alaih can also be subject to criminal charges The problem formulation in this thesis is: How is the over-credit process for subsidized housing at Perumahan Pesona Natar Residence and how is the Sharia Economic Law Review of over-credit carried out privately? This research aims to find out the correct over-credit process according to existing provisions in a bank as well as an analysis of Islamic law and positive law regarding the practice of over kredits carried out under the hands. The type of research in writing this thesis is descriptive field research. The data is in the form of information obtained directly through individual interviews, namely 2 buyers and sellers . The sampling technique used by the author in this thesis research is research informant. The data collection was carried out through three techniques, namely Interview, Observation and Documentation The results of this research are that the take over process carried out by customers or debtors under their hands, if viewed from sharia economic law, does not fulfill the terms and conditions, both in terms of hawalah terms and conditions and murabahah terms and conditions. Because basically the contract or transaction between the seller's customer and the buyer's customer is mutually acceptable (willing) but from the bank (muhtal) they don't know and they don't necessarily approve of the transaction or contract. In this case, the debt transferred from the seller's customer (muhil) to the buyer's customer (muhal'alaih) is not valid according to Islamic law.
