Abstract

ABSTRAK Maraknya kejadian kekerasan yang terjadi saat ini, tentu menimbulkan kekhawatiran, bahkan ketakutan khususnya bagi perempuan. Karena patut diketahui bahwa perempuan merupakan individual yang paling terdampak atas tindakan kekerasan seksual yang terjadi, bahwa seorang perempuan dikarenakan sistem tata nilai yang mendudukkan perempuan sebagai makhluk yang lemah dan lebih rendah dibandingkan laki-laki perempuan masih ditempatkan dalam posisi subordinasi dan marginalisasi yang harus dikuasai Penelitian ini termasuk penelitian lapangan (field research) dengan menggunakan pendekatan deksriptif kualitatif, sumber data dalam penelitian ini terdiri dari data sekunder dan data primer dengan metode pengumpulan data wawancara, dokumentasi. Dengan rumusan masalah Bagaimana Implementasi Pasal 6 Permendikbud No. 30 Tahun 2021 terhadap Pencegahan dan Penanganan Kekerasan Seksual di Universitas Islam Negeri Raden Intan Lampung. Bagaimana PerspektifFiqih Siyasah Tanfidziyyah tentangImplementasi Pasal 6 Permendikbud No. 30 Tahun 2021terhadap Pencegahan dan Penanganan Kekerasan Seksual di Universitas Islam Negeri Raden Intan Lampung? Dan tujuan penelitian untuk mengetahui bagaimana Bagaimana Implementasi Pasal 6 Permendikbud No. 30 Tahun 2021 terhadap Pencegahan dan Penanganan Kekerasan Seksual di Universitas Islam Negeri Raden Intan Lampung, untuk mengetahui bagaimana Bagaimana Persefektif Fiqih Siyasah Tanfidziyyah terhadap Implementasi Pasal 6 Permendikbud No. 30 Tahun 2021terhadap Pencegahan dan Penanganan Kekerasan Seksual di Universitas Islam Negeri Raden Intan Lampung. Hasil penelitian Keputusan Rektor Universitas Islam Negeri RIL tersebut sudah sesuai dengan Permendikbud Ristek nomor 30 Tahun 2021 tentang pencegahan dan penanganan kekerasan seksual di lingkungan Perguruan Tinggi. Kekerasan seksual banyak terjadi di perguruan tinggi di Indonesia. Dalam Al- Qur’an surah an-Nisā ayat 59. Perintah taat terhadap ulil amri atau pemerintah, dalam surah an Nisā ayat 59 tidak langsung menggunakan redaksi “Taatilah”, berbeda dengan taat kepada Allah dan Rasul-Nya dengan jelas menggunakan redaksi "Taatilah” karena taat kepada ulil amri hanya diperbolehkan pada saat perintah tersebut tidak mengarah kepada hal-hal yang dilarang oleh Allah ta’alā Kata kunci : Kekerasan Seksual, Perguruan TinggiFiqih Siyasah. ABSTARCT The increasing incidents of violence occurring today undoubtedly cause concern, and even fear, especially among women. It should be noted that women are the most affected by acts of sexual violence. Due to a value system that positions women as weak and inferior to men, women are still placed in positions of subordination and marginalization that must be controlled. This research is field research using a descriptive qualitative approach. The data sources in this study consist of secondary and primary data, with data collection methods including interviews and documentation. The research questions are: How is the implementation of Article 6 of Permendikbud No. 30 of 2021 regarding the Prevention and Handling of Sexual Violence at the State Islamic University of Raden Intan Lampung? What is the perspective of Fiqh Siyasah Tanfidziyyah on the implementation of Article 6 of Permendikbud No. 30 of 2021 regarding the Prevention and Handling of Sexual Violence at the State Islamic University of Raden Intan Lampung? The aim of the research is to understand how the implementation of Article 6 of Permendikbud No. 30 of 2021 regarding the Prevention and Handling of Sexual Violence at the State Islamic University of Raden Intan Lampung is carried out, and to understand the perspective of Fiqh Siyasah Tanfidziyyah on the implementation of Article 6 of Permendikbud No. 30 of 2021 regarding the Prevention and Handling of Sexual Violence at the State Islamic University of Raden Intan Lampung. The results of the study show that the Rector's decision at the State Islamic University of Raden Intan Lampung is in accordance with Permendikbud Ristek No. 30 of 2021 on the prevention and handling of sexual violence in higher education institutions. Sexual violence is prevalent in higher education institutions in Indonesia. In the Qur'an, Surah An-Nisa verse 59, the command to obey the ulil amri or government is not directly phrased as "Obey", unlike the clear command to obey Allah and His Messenger, which explicitly uses the phrase "Obey". This is because obedience to ulil amri is only permitted when their orders do not lead to things prohibited by Allah Ta’ala. Keywords: Sexual Violence, Higher Education, Fiqh Siyasah.
