Abstract

ABSTRAK Penggunaan khiyār sangat penting dalam transaksi jual beli motor bekas, karena jenis motor sangat beragam di pasaran, sehingga diperlukan informasi yang akurat mengenai informasi orisinalitas dan kualitas suku cadang motor bekas, dalam pemberian informasi mengenai kualitas sparepart dalam jual beli motor bekas di Showroom Agung Motor Bandar Lampung disampaikan secara transparan dan jujur serta memberikan batas waktu pengembalian motor ditetapkan paling lama dua minggu untuk menghindari penipuan oleh konsumen yang mengatakan motor rusak karena kesalahan pihak showroom sehingga tidak merugikan pihak penjual. Pihak showroom tidak bertanggungjawab atas kerusakan motor pasca pembelian. Namun, pihak pembeli merasa keberatan atas batas waktu yang ditetapkan selama dua minggu tersebut tidak dapat dijadikan waktu untuk pembuktian bahwa motor tersebut sesuai dengan kualitas yang telah di rekomendasikan oleh pihak showroom. Kajian ini bertujuan untuk menjawab rumusan masalah yang ada yaitu 1. Bagaimana Bagaimana praktik jual beli motor bekas di showroom Agung Motor Bandar Lampung? 2. Bagaimana pandangan hukum Islam terhadap praktik jual beli motor bekas di showroom Agung Motor Bandar Lampung? Metode penelitian dalam penelitian ini menggunakan Penelitian Lapangan (Field Research). Menggunakan analisis data melalui observasi, wawancara, dan dokumentasi. Jumlah informan sebanyak 8 orang yaitu 1 orang penjual dan 1 orang penanggung jawab showroom serta 6 orang pembeli. Hasil penelitian menunjukkan bahwa jual beli motor bekas di showroom Agung Motor Bandar Lampung dinyatakan sah karena dalam implementasi khiyār dalam transaksi jual beli motor bekas sudah sesuai dengan perspektif hukum Islam. Kategori syarat khiyār yaitu memilih salah satu dari 3 jenis barang yang akan dibeli, jenis barang yang akan dipilih memiliki perbedaan harga dari jenis yang lainnya, harga juga harus diketahui secara pasti, dan batas waktu khiyār dibatasi sesuai dengan kesepakatan yang telah dilakukan ketika terjadinya transaksi antara penjual dan pembeli. Ketiga aspek tersebut telah terpenuh seluruhnya. Sehingga kesimpulan akhir penulis adalah implemenasi khiyār ta’yīn pada transaksi jual beli motor bekas pada showroom di Agung Motor Bandar Lampung sudah sepenuhnya sesuai dengan konsep khiyār ta’yīn. ABSTRACT The use of khiyār is very important in the transaction of buying and selling used motorcycles, because the types of motorcycles are very diverse on the market, so accurate information is needed regarding the originality and quality of used motorcycle parts, in providing information about the quality of spare parts in buying and selling used motorcycles at the Agung Motor Showroom Bandar Lampung is submitted transparently and honestly and provides a deadline for returning motorcycles set at a maximum of two weeks because for Avoid fraud by consumers who say the motorcycle is damaged due to the fault of the showroom so that it does not harm the seller. How is the practice of buying and selling used motorcycles at the Agung Motor Bandar Lampung showroom? 2. What is the view of Islamic law on the practice of buying and selling used motorcycles at the Agung Motor Bandar Lampung showroom? The research method in this study uses Field Research. Using data analysis through observation, interviews, and documentation. The number of informants is 10 people, namely 1 seller and 3 people in charge of the showroom and 6 buyers. The results of the study show that the buying and selling of used motorcycles at the Agung Motor Bandar Lampung showroom is declared legal because the information system carried out by the Agung Motor Bandar Lampung showroom in the sale of used motorcycles is carried out in a transparent and honest manner by providing all information related to the condition of the motorcycle which includes a history of motorcycle damage, mileage during use, ownership books and tax payment letters.. The warranty period provided by the showroom is two weeks. The category of khiyār conditions is to choose one of the 3 types of goods to be purchased, the type of goods to be chosen has a price difference from the other types and the price must also be known for sure, And the time limit for khiyār is limited according to the agreement that has been made when the transaction between the seller and the buyer occurs. These three aspects have been fully fulfilled. So that the author's final conclusion is that the implementation of khiyār ta'yīn in the transaction of buying and selling used motorcycles at the showroom in Agung Motor Bandar Lampung is fully in accordance with the concept of khiyār ta'yīn.
