Abstract
ABSTRAK Salah satu problematika tentang wakaf yang terjadi di Mesjid Al�Muawanah di Desa Kaliasin Kecamatan Tanjung Bintang Kabupaten Lampung Selatan adalah terjadinya penjualan barang bekas harta benda wakaf. Setelah mesjid dibongkar sebagian benda-benda wakaf mesjid tersebut yang tidak terpakai tetapi masih bisa dimanfaatkan, seperti genteng, kayu, batu, kaca, dan kubah mesjid dijual kepada beberapa orang. Hasil penjualan oleh pengurus mesjid dan nazir dibelikan pengganti benda-benda tersebut dengan benda-benda yang lebih bermanfaat. Permasalahan yang diangkat dalam penelitian ini adalah: 1). Bagaimana analisisis hukum ekonomi syariah dan Hukum Positif tentang praktik jual beli material harta benda wakaf di Mesjid Al-Muawanah Desa Kaliasin Kecamatan Tanjung Bintang Kabupaten Lampung Selatan 2). Bagaimana persamaan dan perbedaan Hukum Ekonomi Syariah dan Hukum Positif tentang praktik jual beli material harta benda wakaf di Mesjid Al-Muawanah Desa Kaliasin Kecamatan Tanjung Bintang Kabupaten Lampung Selatan. Penelitian ini merupakan penelitian lapangan (field research) yang menggunakan 3 sumber data, yaitu data primer, sekunder dan tersier. Penelitian ini bersifat deskriptif analisis. Data yang terkumpul dianalisis secara kualitatif dan komparatif, yaitu perbandingan Hukum Islam dan Hukum Positif. Berdasarkan hasil analisis tersebut ditemukan bahwa pandangan hukum Islam terhadap praktik jual beli material harta benda wakaf masjid Al�Muawananah Desa Kaliasin Kecamatan Tanjung Bintang Kabupaten Lampung Selatan diperbolehkan. Hal itu sesuai dengan pendapat mayoritas ulama‟ yang membolehkan jual beli barang bekas wakaf (Abu Hanafi, Maliki dan Ahmad bin Hambal) yang berpendapat bahwa harta benda wakaf yang sudah tidak mendatangkan manfaat boleh dijual/ditukar dan hasil dari penjualan tersebut akan mendatangkan kemanfaatan yang baru bagi benda wakaf tersebut, dan hal ini tidak terlepas dari aspek kemaslahatan umat. Sedangkan dalam Hukum Positif praktik jual beli harta benda wakaf juga diperbolehkan dengan alasan harta benda wakaf tersebut tidak dapat dipertahankan lagi baik bentuk fisik maupun kegunaannya. Persamaan hukum Islam dan hukum positif terkait dengan praktik jual beli material bekas harta benda wakaf yang terjadi di mesjid Al�Muawanah sama-sama diperbolehkan dengan syarat hasil penjualan tersebut kembali lagi kepada wakaf karena hasil penjualan benda wakaf tersebut bisa untuk melanjutkan, menjaga dan melestarikan benda wakaf tersebut. Adapun perbedaannya adalah dalam hukum Islam dapat dilakukan dengan musyawarah oleh masyarakat setempat atau dengan persetujuan tertulis dari Kepala Kantor Urusan Agama Kecamatan Tanjung Bintang Kabupaten Lampung Selatan dan menurut Hukum Positif, proses pergantian harta benda wakaf, sebagaimana tercantum dalam Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf, pada Pasal 41 pergantian harta benda wakaf dapat dilakukan setelah memperoleh izin tertulis dari Menteri atas persetujuan Badan Wakaf Indonesia. Kata Kunci: Jual Beli, Istibdāl, Harta Benda Wakaf. iv ABSTRACT One of the problems regarding waqf that occurred at the Al-Muawanah Mosque in Kaliasin Village, Tanjung Bintang District, South Lampung Regency is the sale of used waqf property. After the mosque was dismantled, some of the unused but still usable waqf objects, such as roof tiles, wood, stone, glass, and the mosque dome, were sold to several people. The proceeds from the sale by the mosque administrators and nazir were used to replace these objects with more useful objects. The problems raised in this study are: 1). How is the analysis of Islamic economic law and Positive Law regarding the practice of buying and selling waqf property materials at the Al-Muawanah Mosque, Kaliasin Village, Tanjung Bintang District, South Lampung Regency 2). What are the similarities and differences between Islamic Economic Law and Positive Law regarding the practice of buying and selling waqf property materials at the Al-Muawanah Mosque, Kaliasin Village, Tanjung Bintang District, South Lampung Regency. This research is a field research that uses 3 data sources, namely primary, secondary and tertiary data. This research is descriptive analysis. The collected data are analyzed qualitatively and comparatively, namely the comparison of Islamic Law and Positive Law. Based on the results of the analysis, it was found that the Islamic legal view on the practice of buying and selling waqf property of the Al-Muawananah Mosque, Kaliasin Village, Tanjung Bintang District, South Lampung Regency is permitted. This is in accordance with the opinion of the majority of scholars who allow the sale and purchase of used waqf goods (Abu Hanafi, Maliki and Ahmad bin Hambal) who argue that waqf property that no longer provides benefits can be sold/exchanged and the proceeds from the sale will provide new benefits for the waqf property, and this is inseparable from the aspect of the welfare of the community. While in Positive Law the practice of buying and selling waqf property is also permitted on the grounds that the waqf property can no longer be maintained either in physical form or in its usefulness. The similarities between Islamic law and positive law related to the practice of buying and selling used waqf property materials that occurred at the Al�Muawanah mosque are both permitted on condition that the proceeds from the sale are returned to the waqf because the proceeds from the sale of the waqf property can be used to continue, maintain and preserve the waqf property. The difference is that in Islamic law it can be done through deliberation by the local community or with written approval from the Head of the Religious Affairs Office of Tanjung Bintang District, South Lampung Regency and according to Positive Law, the process of replacing waqf property, as stated in Law Number 41 of 2004 concerning Waqf, in Article 41 the replacement of waqf property can be done after obtaining written permission from the Minister with the approval of the Indonesian Waqf Agency.
