Abstract
ABSTRAK Kedisiplinan Aparatur Sipil Negara (ASN) masih tergolong tingkat rendah dalam keefektifan disiplin Pegawai Negeri Sipil, salah satunya pada Kantor Kecamatan Padang Ratu Kabupaten Lampung Tengah. Permasalahan yang terjadi pada Kantor Kecamatan Padang Ratu Kabupaten Lampung Tengah adalah kurangnya tingkat disiplin terhadap ketentuan jam kerja seperti datang terlambat, tidak mengikuti apel pagi, pulang lebih awal dan membolos sehingga berpengaruh pada kinerja Aparatur Sipil Negara (ASN). Berdasarkan latar belakang di atas peneliti tertarik untuk melakukan penelitian dengan judul “Tinjauan Fiqh Siyasah Terhadap Pelaksanaan Pasal 24 Undang-Undang Nomor 20 Tahun 2023 Tentang Aparatur Sipil Negara (Studi di Kantor Kecamatan Padang Ratu Kabupaten Lampung Tengah).” Jenis penelitian dalam skripsi ini termasuk penelitian lapangan (field research). Wawancara yang dilakukan dalam penelitian ini ditujukan kepada 6 orang, yakni 1 orang Camat dan 5 orang Aparatur Sipil Negara (ASN) di Kantor Kecamatan Padang Ratu Kabupaten Lampung Tengah. Teknik pengumpulan data dengan wawancara, observasi, dan dokumentasi. Hasil penelitian mengemukakan bahwa pelaksanaan Pasal 24 ayat 1 huruf c Undang-Undang Nomor 20 Tahun 2023 Tentang Aparatur Sipil Negara di Kantor Kecamatan Padang Ratu Kabupaten Lampung Tengah belum maksimal. Hal ini dibuktikan banyak para Aparatur Sipil Negara melakukan pelanggaran mengenai kedisiplinan waktu kerja sehingga Aparatur Sipil Negara kurang maksimal melaksanakan tugas kedinasan dengan penuh pengabdian, kejujuran, kesadaran, dan tanggung jawab. Rendahnya kesadaran hukum, tidak ada responsif oleh Aparatur Sipil Negara (ASN), keterbatasan sarana dan prasarana, terbatasnya kuantitas dan kualitas sumber daya manusia menjadi faktor penghambat pelaksanaan Undang-undang tersebut. Pelaksanaan Pasal 24 ayat 1 huruf c Undang-Undang Nomor 20 Tahun 2023 Tentang Aparatur Sipil Negara di Kantor Kecamatan Padang Ratu Kabupaten Lampung Tengah belum sesuai dengan fiqh siyasah. Hal ini dikarenakan masih banyak Aparatur Sipil Negara (ASN) yang melakukan pelanggaran mengenai disiplin kerja, rendahnya kesadaran hukum, tidak ada responsif oleh Aparatur Sipil Negara (ASN) untuk mematuhi peraturan yang ditetapkan oleh Pemerintah. Dalam Islam, kebijakan dan peraturan perundang-undangan yang ditetapkan penguasa tersebut wajib dipatuhi dan diikuti. Kata kunci : Fiqh Siyasah, Undang-undang, Disiplin, Aparatur Sipil Negara. ABSTRACT The discipline of State Civil Servants (ASN) is still at a low level in terms of the effectiveness of Civil Servant discipline, one of which is at the Padang Ratu District Office, Central Lampung Regency. The problem that occurs at the Padang Ratu District Office, Central Lampung Regency is the lack of discipline regarding working hours provisions such as arriving late, not attending morning roll call, leaving early and playing truant which affects the performance of the State Civil Apparatus (ASN). Based on the above background, researchers are interested in conducting research with the title "Review of Siyasah Fiqh on the Implementation of Article 24 of Law Number 20 of 2023 concerning State Civil Apparatus (Study at the Padang Ratu District Office, Central Lampung Regency)." The type of research in this thesis includes field research. The interviews conducted in this research were aimed at 6 people, namely 1 subdistrict head and 5 state civil servants (ASN) at the Padang Ratu District Office, Central Lampung Regency. Data collection techniques using interviews, observation and documentation. The research results show that the implementation of Article 24 paragraph 1 letter c of Law Number 20 of 2023 concerning State Civil Apparatus at the Padang Ratu District Office, Central Lampung Regency has not been optimal. This is proven by the fact that there are still many State Civil Apparatus (ASN) who commit disciplinary violations at work, low legal awareness, no responsiveness by the State Civil Apparatus (ASN), limited facilities and infrastructure, limited quantity and quality of human resources, poor law enforcement. is still weak so that actions that violate the disciplinary code of ethics that want to be followed up are simply stopped and become an inhibiting factor in implementing the law. The implementation of Article 24 paragraph 1 letter c of Law Number 20 of 2023 concerning State Civil Apparatus at the Padang Ratu District Office, Central Lampung Regency is not in accordance with siyasah fiqh. This is because there are still many State Civil Apparatus (ASN) who commit violations regarding work discipline, there is low legal awareness, there is no responsiveness by the State Civil Apparatus (ASN) to comply with the regulations set by the Government. In Islam, the policies and laws and regulations set by the authorities must be obeyed and followed. This is in accordance with the word of Allah in QS An-Nisa verse 59.
