Abstract

ABSTRAK Sulitnya air bersih menjadi salah satu masalah yang dialami oleh warga Dusun 7 Kampung Mahabang. Dengan adanya peraturan yang mengatur terkait penyediaan air minum merupakan salah satu wujud kepedulian pemerintah dalam memenuhi hak-hak rakyatnya. Dalam Pasal 44 Peraturan Daerah Kabupaten Tulang Bawang Nomor 10 Tahun 2019 Tentang Sistem Penyediaan Air Minum menyebutkan bahwa wewenang dan tanggungjawab pemerintah kampung meliputi: a). Melakukan dukungan terhadap pembinaan dan pengawasan penyelenggaraan SPAM di tingkat kelompok masyarakat; b). Membentuk kelompok masyarakat penyelenggara SPAM; c). Memfasilitasi pelaporan kelompok masyarakat kepada pemerintah kabupaten; dan d). Menyampaikan laporan penyelenggara SPAM di wilayahnya kepada pemerintah kabupaten. Rumusan masalah pada penelitian ini adalah: 1). Bagaimana implementasi Pasal 44 Peraturan Daerah Kabupaten Tulang Bawang Nomor 10 Tahun 2019 Tentang Sistem Penyediaan Air di Kampung Mahabang Kecamatan Dente Teladas Kabupaten Tulang Bawang, 2). Bagaimana perspektif fiqh siya>sah terhadap implementasi Pasal 44 Peraturan Daerah Kabupaten Tulang Bawang Nomor 10 Tahun 2019 Tentang Sistem Penyediaan Air di Kampung Mahabang Kecamatan Dente Teladas Kabupaten Tulang Bawang. Metode penelitian yang digunakan yaitu metode kualitatif dengan jenis penelitian yaitu penelitian lapangan atau field research. Sifat penelitian menggunakan analisis deskriptif. Data-data diperoleh melalui sumber data primer yang diperoleh melalui wawancara dan dokumentasi. Data sekunder diperoleh dari buku, dan jurnal yang relevan. Hasil dari penelitian ini menyatakan bahwa implementasi Pasal 44 Peraturan Daerah Kabupaten Tulang Bawang Nomor 10 Tahun 2019 Tentang Sistem Penyediaan Air di Kampung Mahabang Kecamatan Dente Teladas Kabupaten Tulang Bawang telah berjalan namun belum maksimal. Dilihat dari kualitas air yang dihasilkan masih tergolong keruh sehingga belum layak untuk dikonsumsi. Dalam pandangan siya>sah tanfi\z\iyyah, implementasi ini sudah berjalan sesuai dengan konsep siya>sah tanfi\z\iyyah walaupun hasil dari pelaksanaannya belum maksimal, pemerintah kampung dianggap telah menjalankan tugasnya karena memenuhi amanah yang telah diberikan. Kata kunci: Air bersih, implementasi, peraturan daerah, siya>sah tanfiz\iyyah. ABSTRACT The difficulty of clean water is one of the problems experienced by the residents of Hamlet 7, Kampung Mahabang. The existence of regulations governing the provision of drinking water is a manifestation of the government's concern for fulfilling the rights of its people. In Article 44 of the Tulang Bawang Regency Regional Regulation Number 10 of 2019 concerning Drinking Water Supply Systems, it is stated that the authority and responsibility of the village government includes: a). Supporting the development and supervision of SPAM implementation at the community group level; b). Forming a community group that organizes SPAM; c). Facilitate reporting by community groups to the district government; and d). Submit reports from SPAM organizers in their area to the district government. The problem formulation in this research is: 1). How is the implementation of Article 44 of Tulang Bawang Regency Regional Regulation Number 10 of 2019 concerning the Water Supply System in Mahabang Village, Dente Teladas District, Tulang Bawang Regency, 2). What is the perspective of siya>sah fiqh regarding the implementation of Article 44 of Tulang Bawang Regency Regional Regulation Number 10 of 2019 concerning the Water Supply System in Mahabang Village, Dente Teladas District, Tulang Bawang Regency. The research method used is a qualitative method with the type of research, namely field research. The nature of the research uses descriptive analysis. Data was obtained through primary data sources obtained through interviews and documentation. Secondary data was obtained from relevant books and journals. The results of this research state that the implementation of Article 44 of Tulang Bawang Regency Regional Regulation Number 10 of 2019 concerning the Water Supply System in Mahabang Village, Dente Teladas District, Tulang Bawang Regency has been running but is not optimal. Judging from the quality of the water produced, it is still relatively cloudy so it is not suitable for consumption. In the view of siya>sah tanfi\z\iyyah, this implementation has proceeded in accordance with the concept of siya>sah tanfi\z\iyyah even though the results of the implementation have not been optimal, the village government is considered to have carried out its duties because it has fulfilled the mandate that has been given.
