Abstract

ABSTRAK Kejahatan kadang kala tidak bisa diprediksi kedatangannya. Pencurian, pelecehan, pembegalan, atau rencana pembunuhan adalah macam kejahatan yang mengerikan, maka Islam menganjurkan kita untuk membela diri. Pembelaan diri merupakan suatu hak yang dimiliki oleh naluri setiap orang untuk mempertahankan dirinya maupun orang lain, harta benda dan kehormatannya dari segala ancaman atau serangan perbuatan jahat pihak lain secara melawan hukum. Maqashid Syariah, pembelaan diri diorientasikan untuk mencapai tujuan-tujuan syariat, seperti menjaga agama, jiwa, akal, keturunan, dan harta benda, dengan dampak positif pada kesejahteraan masyarakat. Berdasarkan dari beberapa uraian di atas, maka peneliti sangat tertarik untuk membahas lebih dalam terkait konsep pembelaan diri ini dalam Al-Qur‟an melalui pendekatan tafsir Maqashid. Rumusan masalah dalam penelitian ini yaitu Bagaimana konsep pembalasan dalam pembelaan diri pada ayat-ayat Al-Qur‟an melalui pendekatan Tafsir Maqashid. Adapun tujuan penelitian ini yaitu untuk mengetahui konsep pembalasan dalam pembelaan diri pada ayat-ayat Al-Qur‟an melalui pendekatan Tafsir Maqashid. Jenis penelitian ini adalah penelitian kepustakaan (library research) atau studi teks yang bersifat deskriptif. Dalam penelitian ini peneliti menggunakan pendekatan maudhu’i, metode pengumpulan data dalam penelitian ini menggunakan metode studi perpustakaan. Hasil Penelitian menunjukkan bahwa konsep pembalasan dalam pembelaan diri pada ayat Al-Qur‟an melalui pendekatan tafsir maqashid, dapat disimpulkan bahwa syariat qiṣāṣ terdapat tujuan maqashid yang mulia yaitu menciptakan kemaslahatan bagi kehidupan manusia dan menjamin kehidupan. Hal tersebut sesuai firman Allah dalam surat Al-Baqarah ayat 178 tersebut mengisyaratkan akan kehendak Allah yang sangat mulia yaitu menciptakan kemaslahatan bagi kehidupan manusia. Syariat qisas ini memiliki maqṣād (tujuan) untuk menjamin kehidupan berdasarkan firman Allah pada surat al�Baqarah ayat 179. Kata Kunci: Pembelaan diri, Tafsir Maqashid, Qisas. ABSTRACT Crime sometimes cannot be predicted. Theft, harassment, beheading, or attempted murder are terrible crimes, so Islam encourages us to defend ourselves. Self-defense is a right possessed by the instinct of every person to defend himself or herself or others, his property and honor from all threats or attacks of other parties' evil deeds unlawfully. Maqashid Sharia, self-defense is oriented to achieve sharia goals, such as safeguarding religion, soul, intellect, descendants, and property, with a positive impact on the welfare of the community. Based on some of the descriptions above, the researcher is very interested in discussing more deeply the concept of self-defense in the Qur'an through the Maqashid tafsir approach. The formulation of the problem in this study is how the concept of retribution in self-defense in the verses of the Qur'an through the Tafsir Maqashid approach. The purpose of this research is to find out the concept of retribution in self-defense in the verses of the Qur'an through the Tafsir Maqashid approach. This type of research is library research or descriptive text studies. In this study, the researcher uses the maudhu'i approach, the data collection method in this study uses the library study method. The results of the study show that the concept of retribution in self-defense in the verses of the Qur'an through the approach of maqashid tafsir, it can be concluded that the sharia of qiṣāṣ has a noble purpose of maqashid, which is to create benefits for human life and guarantee life. This is according to the words of Allah in Surah Al-Baqarah verse 178 which hints at the very noble will of Allah, which is to create benefits for human life. This qisas sharia has a maqṣād (purpose) to guarantee life based on the word of Allah in Surah al-Baqarah verse 179. Keywords: Self-defense, Tafsir Maqashid, Qisas.
