Abstract

ABSTRAK Perkawinan dalam hukum Islam adalah suatu akad yang diikatkan untuk menghalalkan hubungan antara laki-laki dan parempuan dalam kebahagian hidup keluarga yang diikuti oleh cinta dan kasi sayang dengan cara diridhai Allah. Warisan dalam hukum adat adalah aturan�aturan hukum adat yang mengatur tentang bagaimana harta peninggalan atau harta warisan diteruskan atau dibagikan dengan para pewaris dan dari generasi dan generasi berikutnya. Salah satu tradisi yang masih mempertahankan warisan berdasarkan hukum adat adalah tradisi semanda. Berdasarkan uraian diatas dapat dirumuskan permasalahannnya yaitu, apa faktor-faktor penyebab pergeseran nilai adat semanda di Desa Sukanegara Kecamatan Pesisir Tengah Kabupaten pesisir Barat? bagaimana tinjauan hukum keluarga Islam terhadap pergeseran nilai adat semanda di Desa Sukanegara Kecamatan Pesisir Tengah Kabupaten pesisir Barat? Tujuan peneliti ini untuk mengetahui tentang pergeseran nilai adat semanda di Desa Sukanegara Kecamatan Pesisir Tengah Kabupaten pesisir Barat dan mengetahui pergeseran nilai adat semanda apakah bertentangan dengan hukum Islam atau tidak. Jenis penelitian ini adalah penelitian lapangan atau (field research), metode yang digunakan metode kualitatif. Sifat penelitian ini adalah deskriptif analisis. Sumber data dalam penelitian ini yaitu sumber data primer dan sukender. Berdasarkan hasil penelitian dalam skripsi ini dapat ditarik kesimpulan bahwa faktor penyebab pergeseran nilai dalam hukum adat semanda adalah tuntutan kebutuhan ekonomi tingginya biaya hidup. Ketika suami yang menikah secara semanda menuntut hak waris maka ditinjau dari hukum Islam pergeseran ini masih dapat dibenahkan karena suami mempunyai hak, atau waris istrinya. Ditinjau dari hukum Islam terjadinya pergeseran kepemilikan hak waris dari hukum adat semanda sesuai dengan hukum islam karena suami istri berhak saling mewarisi. Kata kunci : Hukum Islam, Hukum Adat, Semanda. iv ABSTRACT Marriage in Islamic law is a contract that is bound to legitimize the relationship between a man and a woman in a happy family life followed by love and affection in a way that is approved by Allah. Inheritance in customary law is the rules of customary law that regulate how inheritance or inheritance is passed on or distributed to heirs and from generation to generation. One tradition that still maintains inheritance based on customary law is the semanda tradition. Based on the description above, the problem can be formulated, namely, what are the factors that cause the shift in the customary values of semanda in Sukanegara Village, Pesisir Tengah District, Pesisir Barat Regency? How is the review of Islamic family law regarding the shift in the customary values of semanda in Sukanegara Village, Pesisir Tengah District, Pesisir Barat Regency? The purpose of this researcher is to find out about the shift in the customary values of semanda in Sukanegara Village, Pesisir Tengah District, Pesisir Barat Regency and to find out whether the shift in the customary values of semanda is contrary to Islamic law or not. This type of research is field research, the method used is a qualitative method. The nature of this research is descriptive analysis. The data sources in this study are primary and secondary data sources. Based on the results of the research in this thesis, it can be concluded that the factor causing the shift in values in the Semanda customary law is the demands of economic needs for the high cost of living. When a husband who is married in a Semanda marriage demands inheritance rights, then in terms of Islamic law this shift can still be corrected because the husband has the right, or his wife's inheritance. In terms of Islamic law, the shift in ownership of inheritance rights from the Semanda customary law in accordance with Islamic law, husband and wife have the right to inherit each other.
