Abstract

ABSTRAK Kegiatan perdagangan oleh PKL seringkali menjadi isu yang memerlukan penyelesaian karena bertentangan dengan peraturan-peraturan tertentu. Namun, pada beberapa kasus, aktivitas PKL juga dapat memberikan kontribusi positif bagi masyarakat dan lingkungan sekitarnya. Maka rumusan penelitian ini Bagaimana Implementasi Pasal 32 ayat (1) Perda Kota Bandar Lampung Nomor 1 tahun 2018 dalam menciptakan masyarakat yang tentram dan ketertiban umum pada pedagang kaki lima dan Bagaimana Implemetasi Pasal 32 ayat (1) Perda Kota Bandar Lampung Nomor 1 tahun 2018 dalam menciptakan masyarakat yang tentram dan ketertiban umum pada pedagang kaki lima perspektif fiqh Siyasah Tanfidziyah. Adapun tujuan penelitian untuk mengetahui Implementasi Pasal 32 ayat (1) Perda Kota Bandar Lampung Nomor 1 tahun 2018 dalam menciptakan masyarakat yang tentram dan ketertiban umum pada pedagang kaki lima dan untuk mengetahui Implemetasi Pasal 32 ayat (1) Perda Kota Bandar Lampung Nomor 1 tahun 2018 dalam menciptakan masyarakat yang tentram dan ketertiban umum pada pedagang kaki lima perspektif fiqh Siyasah Tanfidziyah. Penelitian ini berjenis penelitian lapangan (field research) dan bersifat deskriptif. Teknik sampling yang digunakan penulis dalam penelitian skripsi ini adalah Representative sampling. Maka, jumlah seluruh sampel yaitu ada 8 anggota sehingga, memudahkan peneliti dalam melakukan penelitian. Adapun teknik pengumpulan data yang digunakan berupa, observasi, dokumentasi, dan wawancara. Hasil penelitian menunjukkan bahwa Implementasi Pasal 32 Ayat (1) Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2018 Tentang Ketenteraman Masyarakat dan Ketertiban Umum terlaksana dengan baik, tetapi Keberadaan PKL yang membuat pengunjung atau konsumen menjadi parkir sembarangan. Konsumen dikawasan lungsir bukan hanya orang dewasa saja tetapi adapula anak-anak, yang mengakibatkan mengganggu para pengendara kendaraan bermotor dan mengganggu kelancaran lalu lintas. Berdasarkan Tinjauan Siyasah Tanfidziyah, bahwa pelaksanaan Pasal 32 Ayat (1) Peraturan Daerah Kota Bandar Lampung Nomor 1 Tahun 2018 Tentang Ketenteraman Masyarakat dan Ketertiban Umum telah sesuai dengan pelaksanaan Peraturan Perundang-undangan negara. Harapannya adalah Pemerintah Kota Bandar Lampung dapat mengelola pedagang kaki lima dengan bijaksana dan mengeluarkan peraturan yang lebih rinci mengenai mereka tanpa merugikan pihak lain. ABSTRACT Trading activities by street vendors often become an issue that requires resolution because they conflict with certain regulations. However, in some cases, street vendors' activities can also make a positive contribution to the community and surrounding environment. So the formulation of this research is How to Implement Article 32 paragraph (1) of the Bandar Lampung City Regional Regulation Number 1 of 2018 in creating a peaceful society and public order for street vendors and How to Implement Article 32 paragraph (1) of the Bandar Lampung City Regional Regulation Number 1 of 2018 in creating a peaceful society and public order from street vendors from a fiqh Siyasah Tanfidziyahh perspective. The aim of the research is to determine the implementation of Article 32 paragraph (1) of the Bandar Lampung City Regional Regulation Number 1 of 2018 in creating a peaceful society and public order for street vendors and to determine the Implementation of Article 32 paragraph (1) of the Bandar Lampung City Regional Regulation Number 1 of 2018 in creating a peaceful society and public order for street vendors from a fiqh siyasah Tanfidziyah perspective. This research is field research and is descriptive in nature. The sampling technique used by the author in this thesis research is Representative sampling. So, the total number of samples is 8 members, making it easier for researchers to conduct research. The data collection techniques used were observation, documentation and interviews. The research results show that the implementation of Article 32 Paragraph (1) of Bandar Lampung City Regional Regulation Number 1 of 2018 concerning Community Peace and Public Order is carried out well, but the presence of street vendors causes visitors or consumers to park carelessly. Consumers in the warp area are not only adults but also children, which causes disturbances to motor vehicle drivers and disrupts the smooth flow of traffic. Based on the Siyasah Tanfidziyah review, the implementation of Article 32 Paragraph (1) of Bandar Lampung City Regional Regulation Number 1 of 2018 concerning Community Peace and Public Order is in accordance with the implementation of state laws and regulations. The hope is that the Bandar Lampung City Government can manage street vendors wisely and issue more detailed regulations regarding them without harming other parties.
