Abstract

ABSTRAK Melihat maraknya kasus perceraian yang terjadi dimasyarakat sekarang dan masalah yang timbul akibat adanya perceraian, perjanjian pra nikah dapat menjadi solusi untuk mengatasi masalah tersebut. Perjanjian pra nikah tersebut akan membantu untuk memecahkan masalah yang akan dihadapi setelah pernikahan. Dan diharapkan dapat menjadi acuan jika suatu saat timbul konflik serta menjadi salah satu landasan masing-masing pasangan dalam melaksanakan, dan memberikan batas-batas hak dan kewajiban mereka. Permasalahan dalam penelitian ini adalah bagaimana perspektif Lembaga Bahtsul Masail Nahdhatul Ulama tentang perjanjian pra nikah. Metode dalam penelitian ini adalah metode kualitatif dengan pendekatan induktif. Jenis penelitian yang dipakai penulis adalah yaitu library research (studi pustaka), yaitu dalam hal ini penelitian yang menggunakan hasil putusan tentang perjanjian pra nikah menurut LBMNU sesuai dengan topik pembahasan yang sedang diangkat sebagai sumber rujukan. Penelitian ini bersifat deskriptif, menggunakan sumber data sekunder. Hasil analisis penulis dalam penelitian ini adalah Seluruh isi perjanjian sah dengan catatan tidak melanggar syariat Islam, batas�batas hukum dan kesusilaan. Para pihak yang terkait dalam perjanjian tersebut hukumnya wajib untuk memenuhi persyaratan. Berdasarkan hasil penelitian dalam skripsi ini maka dapat disimpulkan bahwa Tinjauan syariat Islam tentang perjanjian pra nikah dari pandangan LBMNU lebih mengedepankan pembahasan isi perjanjian pra nikah yakni berkaitan dengan aturan bagaimana harta kekayaan akan di bagi-bagikan jika seandainya terjadi perceraian atau kematian dari satu pasangan, perselingkuhan dan semua urusan yang berkaitan dengan keluarga selama perkawinan atau pernikahan berlangsung. Kata Kunci: Perjanjian Pra Nikah, Hukum Perkawinan Indonesia. ABSTRACT Seeing the increasing number of divorce cases that occur in society today and the problems that arise as a result of divorce, a prenuptial agreement can be a solution to overcome these problems. The pre-nuptial agreement will help to solve problems that will be faced after marriage, such as property disputes, child custody, debt problems or others. And it is hoped that it can be a reference if a conflict arises and become one of the foundations for each partner in carrying out and defining the limits of their rights and obligations. The problem in this research is the perspective of the Bahtsul Masail Nahdhatul Ulama Institute regarding pre-nuptial agreements. The aim of this research is to determine the perspective of the LBMNU of Lampung Province regarding pre-nuptial agreements. The method in this research is a qualitative method with an inductive approach. The type of research used by the author is the type of research used, namely library research, namely in this case research that uses the results of decisions regarding pre-nuptial agreements according to the LBMNU in accordance with the topic of discussion that is being raised as a reference source. This research is descriptive in nature, namely a method of researching an object with the aim of making a description. This research focuses on library materials only without requiring field research. Using secondary data sources. Based on the results of the research in this thesis, it can be concluded that the review of Islamic law regarding pre-nuptial agreements from the perspective of the Bahtsul Masail NU Institute prioritizes discussion of the contents of pre-nuptial agreements, namely relating to the rules on how assets will be distributed in the event of a divorce or death of one partner, infidelity and all matters relating to the family during the marriage or marriage. The entire contents of the agreement are valid provided that they do not violate Islamic law, legal boundaries and morality. Keywords: Prenuptial Agreement, Indonesian Marriage Law.
