Abstract

ABSTRAK Terkait kepemimpinan Kepala Desa Labuhan Ratu Baru Kecamatan Way Jepara Kabupaten Lampung Timur menimbulkan pro dan kontra di kalangan warga setempat, karena Kepala Desa telah mengalami sakit struk selama 1 tahun terakhir sehingga dalam kurun waktu tersebut sarana dan prasarana serta produktivitas pemerintahan desa tidak berjalan sama sekali dan dapat dikatakan kondisi pemerintahan desa telah vakum. Rumusan masalah dalam penelitian ini adalah bagaimana implementasi Pasal 8 Peraturan Menteri Dalam Negeri Nomor 82 Tahun 2015 Tentang Pengangkatan dan Pemberhentian Kepala Desa di Desa Labuhan Ratu Baru Kecamatan Way Jepara Kabupaten Lampung Timur? Dan bagaimana perspektif siyāsah tanfiżiyah terhadap implementasi Pasal 8 Peraturan Menteri Dalam Negeri Nomor 82 Tahun 2015 Tentang Pengangkatan dan Pemberhentian Kepala Desa di Desa Labuhan Ratu Baru Kecamatan Way Jepara Kabupaten Lampung Timur? Penelitian ini adalah jenis penelitian lapangan (field research) dan bersifat deskriptif analisis. Adapun yang menjadi informan sebagai sumber data primer dalam penelitian ini adalah 8 orang yaitu 4 orang Aparatur Pemerintah Desa, 4 orang masyarakat Desa Labuhan Ratu Baru Kecamatan Way Jepara Kabupaten Lampung Timur. Teknik pengumpulan data dengan wawancara, observasi, dan dokumentasi. Teknik analisa data dengan reduksi data, data display, dan penarikan kesimpulan. Hasil penelitian mengemukakan bahwa Implementasi Pasal 8 Peraturan Menteri Dalam Negeri Nomor 82 Tahun 2015 Tentang Pengangkatan dan Pemberhentian Kepala Desa di Desa Labuhan Ratu Baru Kecamatan Way Jepara Kabupaten Lampung Timur belum sesuai. Pasal 8 Peraturan Menteri Dalam Negeri Nomor 82 Tahun 2015 Tentang Pengangkatan dan Pemberhentian Kepala Desa menyatakan bahwa Kepala Desa dapat melaksanakan tugas secara berkelanjutan atau berhalangan tetap secara berturut-turut selama 6 (enam) bulan. Sedangkan Kepala Desa Labuhan Ratu Baru masih menjabat dan tidak mau mengundurkan diri padahal Kepala Desa tidak dapat menjalankan tugas dan fungsinya. Implementasi Pasal 8 Peraturan Menteri Dalam Negeri Nomor 82 Tahun 2015 Tentang Pengangkatan dan Pemberhentian Kepala Desa di Desa Labuhan Ratu Baru Kecamatan Way Jepara Kabupaten Lampung Timur tidak sesuai dengan prinsip siyāsah tanfiżiyah. Kepala Desa Labuhan Ratu Baru masih menjabat dan tidak mau mengundurkan diri padahal Kepala Desa tidak dapat menjalankan tugas dan fungsinya. Seorang pemimpin harus bersifat amanah, sebab ia akan diserahi tanggungjawab sebagaimana yang tercantum dalam QS. Al-Mukminun ayat 8-9. The formulation of the problem in this research is how to implement Article 8 of the Minister of Home Affairs Regulation Number 82 of 2015 concerning the Appointment and Dismissal of Village Heads in Labuhan Ratu Baru Village, Way Jepara District, East Lampung Regency? And what is the perspective of siyāsah Tanfiẓiyah regarding the implementation of Article 8 of the Minister of Home Affairs Regulation Number 82 of 2015 concerning the Appointment and Dismissal of Village Heads in Labuhan Ratu Baru Village, Way Jepara District, East Lampung Regency? This research is a type of field research and is descriptive analysis. The informants who served as primary data sources in this research were 8 people, namely 4 Village Government Apparatus, 4 people from Labuhan Ratu Baru Village, Way Jepara District, East Lampung Regency. Data collection techniques using interviews, observation and documentation. Data analysis techniques using data reduction, data display, and drawing conclusions. The results of the research show that the implementation of Article 8 of the Minister of Home Affairs Regulation Number 82 of 2015 concerning the Appointment and Dismissal of Village Heads in Labuhan Ratu Baru Village, Way Jepara District, East Lampung Regency is not appropriate. Article 8 of the Minister of Home Affairs Regulation Number 82 of 2015 concerning the Appointment and Dismissal of Village Heads states that Village Heads can carry out their duties continuously or be permanently absent for 6 (six) months. Meanwhile, the Village Head of Labuhan Ratu Baru is still in office and does not want to resign even though the Village Head cannot carry out his duties and functions. The implementation of Article 8 of the Minister of Home Affairs Regulation Number 82 of 2015 concerning the Appointment and Dismissal of Village Heads in Labuhan Ratu Baru Village, Way Jepara District, East Lampung Regency is not in accordance with the principles of siyāsah Tanfiẓiyah. The Village Head of Labuhan Ratu Baru is still in office and does not want to resign even though the Village Head cannot carry out his duties and functions. A leader must be trustworthy, because he will be entrusted with responsibilities as stated in the QS. Al-Mukminun verses 8-9.
