Abstract

ABSTRAK Sebagai perusahaan jasa sewa rental mobil, ASSA RENT Bandar Lampung mempunyai misi untuk memenuhi kebutuhan konsumen dan pelayanannya serta menjaga kepercayaan konsumen dalam upaya untuk meningkatkan usaha dan membangun produktifitasnya sebagai tempat usaha. Dalam praktiknya, ada konsumen yang berselisih paham terkait adanya denda diakhir masa sewa. Adanya klausula baku pada perjanjian sewa menjadi sangat penting. Adapun masalah yang diteliti yakni Bagaimana Pelaksanaan Klausula Baku Pada Praktik Sewa Menyewa Rental Mobil di ASSA RENT Bandar Lampung? Bagaimana Pandangan Hukum Islam Terhadap Klausula Baku Pada Praktik Sewa Menyewa Rental Mobil di ASSA RENT Bandar Lampung? Penelitian ini bertujuan untuk mengetahui Pelaksanaan Klausula Baku Pada Praktik Sewa Menyewa Rental Mobil di ASSA RENT Bandar Lampung serta untuk mengetahui Pandangan Hukum Islam Terhadap Klausula Baku Pada Praktik Sewa Menyewa Rental Mobil di ASSA RENT Bandar Lampung. Jenis penelitian ini yait “field research” Penelitian ini bersifat deskriptif analitis. Sumber data yang diperoleh yaitu data primer dan data sekunder . Pada penelitian ini diperoleh bahwa pihak jasa rental mobil telah mengantisipasi kerusakan yang terjadi pada mobil rental yang disewakan. Untuk menunjang proses bisnis berjalan dengan lancar, pihak jasa rental mobil membuat suatu klausula baku yang disetujui oleh pihak penyewa rental mobil. Banyak dari pihak penyewa jasa rental yang mengeluh dan merasa terbebani akan hal itu. Tetapi dengan terpaksa mereka harus membayar biaya tambahan untuk memilih jalan damai karena telah menyetujui klausula baku yang diterapkan Pada penerapannya ganti rugi (ta’widh) dengan adanya klausula baku sudah memenuhi kerugian yang dimaksud yaitu biaya�biaya riil. Oleh karenanya menurut hukum Islam harus ada unsur kejelasan pada ganti rugi (ta’widh) agar tidak ada pihak yang merasa dirugikan Kata Kunci : Klausula Baku, Ta’widh, Hukum Islam. ABSTRACT As a car rental service company, ASSA RENT Bandar Lampung has a mission to meet consumer needs and services as well as maintain consumer trust in an effort to improve business and build productivity as a place of business. In practice, there are consumers who disagree regarding the existence of fines at the end of the rental period. The existence of standard clauses in the rental agreement is very important. The problem studied is How to Implement Standard Clauses in Car Rental Rental Practices at ASSA RENT Bandar Lampung? What is the View of Islamic Law on Standard Clauses in Car Rental Rental Practices at ASSA RENT Bandar Lampung? This research aims to determine the implementation of standard clauses in car rental rental practices at ASSA RENT Bandar Lampung and to determine the view of Islamic law towards standard clauses in car rental rental practices at ASSA RENT Bandar Lampung. This type of research is "field research". This research is analytical descriptive. The data sources obtained are primary data and secondary data. In this research, it was found that the car rental service had anticipated damage to the rental car being rented. To support the business process running smoothly, the car rental service creates a standard clause that is agreed to by the car rental renter. Many rental service tenants complain and feel burdened by this. However, they are forced to pay additional costs to choose the peaceful path because they have agreed to the standard clause that is applied. In practice, compensation (ta'widh) with the standard clause already covers the losses, which means real costs. Therefore, according to Islamic law, there must be an element of clarity regarding compensation (ta'widh) so that no party feels disadvantaged Keywords: Standard Clauses, Ta'widh, Islamic Law.
