Abstract

ABSTRAK Fenomena orang dengan gangguan jiwa (ODGJ) semakin banyak berkeliaran dan terlantar di jalanan Kota Bandar Lampung. Hal ini menuntut pemerintah Indonesia untuk bisa memberikan perhatian lebih dengan memberikan pelayanan rehabilitasi sosial. Rumusan masalah dari penelitian ini yaitu bagaimana implementasi Pasal Pasal 7 Peraturan Menteri Sosial Nomor 16 Tahun 2019 Tentang Standar Nasional Rehabilitasi Sosial dan bagaimana tinjauan Fiqh Siyāsah terhadap Implementasi Pasal 7 Peraturan Menteri Sosial Nomor 16 Tahun 2019 Tentang Standar Nasional Rehabilitasi Sosial. Jenis penelitian ini adalah penelitian lapangan (field research) dengan sifat penelitian deskriptif analitis yaitu data yang diperoleh dari lapangan kemudian disimpulkan lalu dianalisis. Analisis data dilakukan dengan menggunakan metode kualitatif. Teknik pengumpulan data dilakukan dengan observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa Dinas Sosial Kota Bandar Lampung sudah melaksanakan sudah melaksanakan Pasal 7 Peraturan Menteri Sosial Nomor 16 Tahun 2019 Tentang Standar Nasional Rehabilitasi Sosial yaitu tahapan-tahapan rehabilitasi sosial yang diantaranya pendekatan awal; asesmen; penyusunan rencana intervensi; intervensi; resosialisasi; terminasi; dan bimbingan lanjut. Adapun faktor hambatan dalam pelaksanaan rehabilitasi sosial terhadap ODGJ yaitu masih adanya keterbatasan jangkauan pesan yang diharapkan mampu sampai pada masyarakat secara umum, belum optimalnya penggunaan media sebagai penyampai pesan, dan adanya pengaruh minimnya pendidikan masyarakat dalam memahami informasi atau pesan yang disampaikan oleh Dinas Sosial Kota Bandar Lampung mengenai upaya rehabilitasi. Sedangkan tinjauan Fiqh Siyāsah, sesuai yang ada di dalam ketatanegaraan Islam, Dinas Sosial Kota Bandar Lampung dalam melaksanakan tugasnya belum sejalan dengan Siyāsah Tanfīżiyyah. Kedudukan Dinas Sosial Kota Bandar Lampung dalam Siyāsah Tanfīżiyyah adalah Wazir Tanfīdz yang hanya melaksanakan apa yang diperintahkan oleh Imam dan menjalankan apa yang telah diputuskan oleh Imam. Jika ia dilibatkan oleh Imam untuk memberikan pendapat, maka ia memiliki fungsi sebagai kewaziran, jika tidak dilibatkan ia lebih merupakan perantara (utusan) belaka. Hal ini sama sifatnya dengan Dinas Sosial Kota Bandar Lampung yang apabila dibutuhkan, hanya bisa memberikan pengusulan. Namun, dalam pengambilan keputusan ada di tangan Khalifah atau Imam sebagai pimpinan. Kata Kunci : ODGJ, Rehabilitasi Sosial, Fiqh Siyāsah. ABSTRACT The phenomenon of people with mental disorders (ODGJ) is increasingly roaming and being abandoned on the streets of Bandar Lampung City. This requires the Indonesian government to pay more attention by providing social rehabilitation services. The formulation of the problem of this research is how to implement Article 7 of the Minister of Social Affairs Regulation Number 16 of 2019 concerning National Standards for Social Rehabilitation and how to review Fiqh Siyāsah regarding the Implementation of Article 7 of the Minister of Social Affairs Regulation Number 16 of 2019 concerning National Standards for Social Rehabilitation. This type of research is field research with the nature of analytical descriptive research, namely data obtained from the field is then concluded and then analyzed. Data analysis was carried out using qualitative methods. Data collection techniques were carried out using observation, interviews and documentation. The results of the research show that the Bandar Lampung City Social Service has implemented Article 7 of the Minister of Social Affairs Regulation Number 16 of 2019 concerning National Standards for Social Rehabilitation, namely the stages of social rehabilitation, including the initial approach; assessment; preparation of intervention plans; intervention; resocialization; termination; and further guidance. The obstacle factors in implementing social rehabilitation for ODGJ are that there is still a limited reach of messages that are expected to reach the community in general, the use of media as a messenger that is not yet optimal, and the influence of the lack of public education in understanding the information or messages conveyed by the Bandar City Social Service. Lampung regarding rehabilitation efforts. Meanwhile, the Siyāsah Fiqh review, in accordance with Islamic state administration, the Bandar Lampung City Social Service in carrying out its duties is not in line with the Siyāsah Tanfīżiyyah. The position of the Bandar Lampung City Social Service in the Siyāsah Tanfīżiyyah is Wazir Tanfīdz who only carries out what is ordered by the Imam and carries out what has been decided by the Imam. If he is involved by the Imam to give an opinion, then he has a function as a vizier, if he is not involved he is more of a mere intermediary (messenger). This is the same as the Bandar Lampung City Social Service which, if needed, can only make recommendations. However, decision making is in the hands of the Caliph or Imam as leader.
