Abstract

TINJAUAN HUKUM ISLAM TENTANG WAKAF DI BAWAH TANGAN (Studi di Kabupaten Way Kanan) FAUZI FADHILLAH 2174130010 ABSTRAK Wakaf adalah suatu kata yang berasal dari bahasa arab, yaitu waqafa yang berarti menahan, menghentikan atau mengekang. Menurut bahasa Indonesia kata wakaf biasa diucapkan dengan wakaf dan ucapan inilah yang dipakai dalam perundang-undangan di Indonesia. Secara terminologi, wakaf memiliki arti yaitu sejenis pemberian yang pelaksanaannya dilakukan dengan jalan menahan (pemilikan) asal (tahbisul ashli). Indonesia telah mengatur wakaf dalam perundang�undangan yang dimana memiliki tujuan untuk melindungi harta wakaf yang telah terjadi. Apa bila wakaf tidak dilakukan dengan benar mengikuti peraturan yang telah dibuat maka yang ditakutkan adalah perlindungan secara hukum di Indonesia yang dimana dianggap tidak sah. Seperti yang terjadi di Kabupaten Way Kanan yang dimana masih belum mengikuti peraturan dan mengikuti prosedur yanng dibuat oleh pemerintah. Hal inilah yang membuat peneliti tertarik untuk mengkaji lebih dalam mengenai faktor-faktor apa saja yang membuat aktivitas wakaf belum memenuhi dan mengikuti peraturan yang dibuat oleh pemerintah. Metode yang digunakan dalam penelitian ini meliputi, jenis penelitian menggunakan penelitian lapangan atau field research, sumber data premier berupa hasil dari wawancara kepada masyarakat dilokasi penelitian yaitu pengurus organisasi islam Nahdlatul Ulama (NU), Muhammadiyah, Lembaga dakwah Islam Indonesia (LDII) dan sumber data sekunder berupa buku-buku atau literasi yang bersangkutan dengan wakaf, metode pengumpulan data menggunakan wawancara langsung, metode analisis data menggunakan analisis yang bersifat deskriptif kualitatif yaitu menjelaskan serta menganalisis nilai praktik wakaf dilembaga yang penulis teliti. Hasil analisis peneltian ini penulis menemukan yaitu, faktor�faktor yang mempengaruhi terjadinya wakaf di bawah tangan didaerah Kabupaten Way Kanan salah satunya yaitu ketidaktahuan nazir dan panjangnya prosedur untuk mendaftarkan wakaf PPAIW, yang dimana menimbulkan dampak hilangnya wakaf dan berubahnya tujuan wakaf dari awal tujuan wakaf dilakukan. According to Indonesian, the word waqf is usually pronounced as waqf and this is the expression used in Indonesian legislation. In terms of terminology, waqf means a type of gift whose implementation is carried out by retaining (ownership) the origin (tahbisul ashli). Indonesia has regulated waqf in legislation which has the aim of protecting existing waqf assets. If waqf is not carried out correctly following the regulations that have been made then what is feared is legal protection in Indonesia which is considered invalid. As happened in Way Kanan Regency, where they still do not follow the regulations and follow the procedures created by the government. This is what makes researchers interested in studying more deeply the factors that cause waqf activities to not comply with and follow the regulations made by the government. The methods used in this research include, the type of research using field research, the primary data source is the results of interviews with the community at the research location, namely administrators of the Islamic organization Nahdlatul Ulama (NU), Muhammadiyah, the Indonesian Islamic Da'wah Institute (LDII) and data sources secondary in the form of books or literacy related to waqf, the data collection method uses direct interviews, the data analysis method uses descriptive qualitative analysis, namely explaining and analyzing the value of waqf practices in the institutions that the author researched. The results of this research analysis, the author found, are the factors that influence the occurrence of illegal waqf in the Way Kanan Regency area, one of which is ignorance of the nazir and the length of the procedure for registering PPAIW waqf, which has the impact of losing the waqf and changing the purpose of the waqf from the initial purpose of the waqf. .
