Abstract

ABSTRAK Peraturan Menteri Sosial Republik Indonesia Nomor 1 Tahun 2018 tentang PKH Pasal 1 ayat (1) berisi Program Keluarga Harapan yang selanjutnya disingkat PKH adalah program pemberian bantuan sosial bersyarat kepada keluarga atau seseorang miskin dan rentan yang terdaftar dalam data terpadu program penanganan fakir miskin, diolah oleh pusat data dan informasi kesejahteraan sosial dan ditetapkan sebagai keluarga penerima bantuan PKH. Peraturan Menteri Sosial Republik Indonesia Nomor 1 Tahun 2018 tentang PKH Pasal 3 yaitu Sasaran PKH merupakan keluarga dan/atau seseorang yang miskin dan rentan serta terdaftar dalam data terpadu program penanganan fakir miskin, memiliki komponen kesehatan,pendidikan, dan/atau kesejahteran sosial. Adapun Rumusan masalah sebagai berikut bagaimana Penyaluran Program Keluarga Harapan Sesuai Dengan Peraturan Menteri Sosial Republik Indonesia Nomor 1 Tahun 2018 Pasal 3 Tentang Penyaluran Bantuan Sosial Program Keluarga Harapan (Studi Kasus Desa Pahmungan, Kecamatan Pesisir Tengah, Kabupaten Pesisir Barat) ? dan bagaimana Analisis Siyāsah Tanfīżiyyah Syar'iyyah Terhadap Peraturan Menteri Sosial Republik Indonesia Nomor 1 Tahun 2018 Pasal 3 Tentang Penyaluran Bantuan Sosial Program Keluarga Harapan (Studi Kasus Desa Pahmungan, Kecamatan Pesisir Tengah, Kabupaten Pesisir Barat) ? Penelitian ini termasuk penelitian lapangan (field research) dengan menggunakan pendekatan deksriptif kualitatif, sumber data dalam penelitian ini terdiri dari data skunder dan data primer dengan metode pengumpulan data observasi, wawancara, dan dokumentasi. Metode pengolahan data pada penelitian ini menggunakan analisis data secara analisis kualitatif dengan cara berpikir induktif. Hasil Penelitian menunjukan analisis Peraturan Menteri Sosial Republik Indonesia Nomor 1 Tahun 2018 Pasal 3 Tentang Penyaluran Bantuan Sosial Program Keluarga Harapan belum sesuai dengan peraturan tersebut dikarenakan masih terdapat masyarakat yang tidak mendapatkan bantuan PKH padahal masyarakat tersebut sangat membutuhkannya dibutuhkan lagi crosh check data masyarakat yang seharusnya menerima bantuan PKH dengan tepat sasaran, dikarenakan pemerintah pusat sudah semaksimal mungkin dalam pendanaan penerima bantuan PKH. Berdasarkan analisis Siyāsah Tanfīżiyyah Syar'iyyah Terhadap Peraturan Menteri Sosial Republik Indonesia Nomor 1 Tahun 2018 Pasal 3 Tentang Penyaluran Bantuan Sosial Program Keluarga Harapan sejalan dengan prinsip dalam Siyāsah Tanfīżiyyah Syar'iyyah yaitu Prinsip kekuasan, keadilan dan kesejahteran. ABSTRACT Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 on PKH Article 1 Paragraph (1) states that the Family Hope Program, hereinafter abbreviated as PKH, is a conditional social assistance program provided to poor and vulnerable families or individuals registered in the integrated data of the poor handling program, processed by the Center for Data and Social Welfare Information, and designated as PKH aid recipients. Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 on PKH Article 3 states that the target of PKH is families and/or individuals who are poor and vulnerable, and are registered in the integrated data of the poor handling program, with components of health, education, and/or social welfare.The research questions are as follows: How is the distribution of the Family Hope Program in accordance with Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 Article 3 regarding the distribution of social assistance for the Family Hope Program (Case Study of Pahmungan Village, Pesisir Tengah Sub-district, West Pesisir District)? And how is the analysis of Siyasah Tanfidziyyah Syar'iyyah on Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 Article 3 regarding the distribution of social assistance for the Family Hope Program (Case Study of Pahmungan Village, Pesisir Tengah Sub-district, West Pesisir District)? This research is a field research using a descriptive qualitative approach. The data sources consist of secondary and primary data, collected through observation, interviews, and documentation. Data processing in this research uses qualitative analysis with inductive reasoning. The research results indicate that the analysis of Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 Article 3 regarding the distribution of social assistance for the Family Hope Program has not yet aligned with the regulations due to the fact that some community members who are in need of PKH assistance are still not receiving it. There is a need for cross-checking of data to ensure that PKH assistance is targeted accurately, as the central government has already maximized funding for PKH recipients. Based on the analysis of Siyasah Tanfidziyyah Syar'iyyah concerning Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 Article 3 regarding the distribution of social assistance for the Family Hope Program, it is in line with the principles of Siyāsah Tanfiżiyyah Syar'iyyah, namely the principles of authority, justice, and welfare.
