Abstract

ABSTRAK Indonesia dan Brunei Darussalam merupakan negara yang mewajibkan adanya Pencatatan perkawinan Dalam Undang-Undang Nomor 22 Tahun 1946 Indonesia ditetapkan bahwa pernikahan adalah sah apabila dilakukan menurut agama Islam yang diawasi oleh pegawai pencatat nikah. Berbeda dengan ketetapan Brunei Darussalam yang mengharuskan adanya pencatatan perkawinan dilakukan dengan imam masjid. Dalam hal inilah pentingnya teori Maqāṣid Syari‘ah pada pencatatan perkawinan yang mencakup lima aspek tujuannya Rumusan Masalah penelitian ini peneliti mengajukan dua fokus kajian yaitu: 1). Bagaimana perbandingan pencatatan perkawinan Indonesia dan Brunei Darussalam?. 2). Bagaimana perspektif maqāṣid syari‟ah terhadap penerapan pencatatan perkawinan Indonesia dan Brunei Darussalam?. Penelitian ini adalah deskriptif analisis komparatif yang didasarkan pada riset Pustaka (Library Research). Bahan hukum yang digunakan Undang-Undang Nomor 1 Tahun 1974 tentang perkawinan dan Peraturan Negara Brunei Darussalam yaitu terdapat pada Laws Of Brunei Chapter 217 dan Penggal 77 Islamic Family Law. Hasil penelitiannya menunjukan bahwa pencatatan perkawinan Indonesia harus dicatat di hadapan Pegawai Pencatat Nikah dan akibat tidak dicatatkan perkawinan istri dan status anak akan dianggap tidak sah dihadapan hukum. Selanjutnya pencatatan perkawinan Brunei Darussalam menetapkan bahwa yang boleh menjadi pendaftar nikah adalah imam masjid. Brunei Darussalam mengancam setiap orang yang tidak melakukan pencatatan perkawinan maka akan dikenakan sanksi berupa denda sebanyak $1000 dolar atau penjara paling lama 3 bulan dan atau keduanya. Konsep Pencatatan perkawinan dengan teori Maqāṣid Syari‟ah sangatlah sesuai dalam KHI, terletak pada perlindungan agama, melindungi hak nafkah dan harta bersama, dan melindungi hak anak. Kata kunci: Pencatatan Perkawinan, Undang-Undang, Maqāṣid Syariah. ABSTRACT Indonesia and Brunei Darussalam are countries that require marriage registration. In Law Number 22 of 1946 Indonesia stipulates that marriage is valid if it is carried out according to the Islamic religion supervised by a marriage registration officer. In contrast to the provisions of Brunei Darussalam which require marriage registration to be carried out by the imam of the mosque. In this case, the importance of Maqāṣid Shari'ah theory on marriage registration includes five aspects of its objectives. The formulation of this research problem is that the researcher proposes two focuses of study, namely: 1). How is the comparison of marriage registration between Indonesia and Brunei Darussalam? 2). What is the maqāṣid syari'ah perspective on the implementation of marriage registration in Indonesia and Brunei Darussalam? The formulation of this research problem is that the researcher proposes two focuses of study, namely: 1). How is the comparison of marriage registration between Indonesia and Brunei Darussalam? 2). What is the maqāṣid shari'ah perspective on the implementation of marriage registration in Indonesia and Brunei Darussalam? This research is a descriptive comparative analysis based on Library Research. The legal materials used are Law Number 1 of 1974 concerning marriage and the State Regulations of Brunei Darussalam, which are found in Laws Of Brunei Chapter 217 and Penggal 77 Islamic Family Law. The results of his research show that Indonesian marriage registration must be recorded before the Marriage Registration Officer and the consequences of not registering the wife's marriage and the status of the child will be considered invalid before the law. Furthermore, Brunei Darussalam's marriage registration stipulates that the one who can be a marriage registrar is the imam of the mosque. Brunei Darussalam threatens that anyone who does not register a marriage will be subject to sanctions in the form of a fine of $1000 dollars or imprisonment for a maximum of 3 months and or both. The concept of marriage registration with Maqāṣid Shari'ah theory is very suitable in KHI, located in the protection of religion, protecting the right to maintenance and joint property, and protecting the rights of children.
