Abstract

ABSTRAK Jual beli adalah kegiatan tukar menukar harta dengan harta, berupa barang yang memiliki nilai dengan uang, memiliki nilai tukar yang sama dan berdasarkan suka sama suka. Jual beli merupakan kegiatan yang selalu terjadi di masyarakat untuk saling memenuhi kebutuhan seperti jual beli gabah di Desa Bumi Agung Wates, Kecamatan Bahuga, Kabupaten Way Kanan, telah dipraktikan sejak dahulu di tengah masyarakat dengan praktik pemotongan berat timbangan. Pemotongan berat timbangan dilakukan dengan pemotongan berat perkarungnya, Rumusan masalah dalam penelitian ini adalah bagaimana praktik pemotongan berat timbangan jual beli gabah di Desa Bumi Agung Wates Kecamatan Bahuga Kabupaten Way Kanan dan Bagaimana tinjauan hukum ekonomi syariah terhadap praktik pemotongan berat timbangan jual beli gabah di Desa Bumi Agung Wates Kecamatan Bahuga Kabupaten Way Kanan. Tujuan penelitian ini untuk mengetahui praktik pemotongan berat timbangan jual beli gabah di Desa Bumi Agung Wates Kecamatan Bahuga Kabupaten Way Kanan dan untuk mengetahui tinjauan hukum ekonomi syariah terhadap praktik pemotongan berat timbangan jual beli gabah di Desa Bumi Agung Wates Kecamatan Bahuga Kabupaten Way Kanan. Penelitian ini merupakan jenis penelitian lapangan (field research), sumber data diperoleh dari data primer dan data sekunder. Berdasarkan hasil penelitian praktik pemotongan berat timbangan jual beli gabah dilakukan untuk mencari berat bersih.petani menjual gabah dengan sistem ini karena segera mendapatkan hasil panen untuk kebutuhan mereka. Terdapat unsur „urf dalam praktik pemotongan berat timbangan jual beli gabah. „Urf dalam praktik jual beli ini termasuk „urf shahih yaitu „urf yang sesuai dengan syariat islam. Ditinjau dari hukum ekonomi syariah praktik pemotongan berat timbangan dalam jual beli gabah di desa Bumi Agung Wates, Kecamatan Bahuga, Kabupaten Way Kanan, sah sebab sudah memenuhi rukun dan syarat jual beli dalam Islam. Praktik ini dibenarkan karena sesuai dengan akad dan jual beli tersebut diperbolehkan. Cutting the weight of the scales is done by cutting the weight of the sack, The formulation of the problem in this study is how the practice of cutting the weight of the grain buying and selling scales in Bumi Agung Wates Village, Bahuga Subdistrict, Way Kanan Regency and how the Islamic economic law reviews the practice of cutting the weight of the grain buying and selling scales in Bumi Agung Wates Village, Bahuga Subdistrict, Way Kanan Regency. The purpose of this study was to determine the practice of cutting the weight of the grain sale and purchase scales in Bumi Agung Wates Village, Bahuga Subdistrict, Way Kanan Regency and to determine the sharia economic law review of the practice of cutting the weight of the grain sale and purchase scales in Bumi Agung Wates Village, Bahuga Subdistrict, Way Kanan Regency. This research is a type of field research, data sources are obtained from primary data and secondary data. Based on the results of the research, the practice of cutting the weight of the grain sale and purchase scales is carried out to find the net weight. Farmers sell grain with this system because they immediately get the harvest for their needs. There is an element of 'urf in the practice of cutting the weight of the grain sale and purchase scales. 'Urf in this sale and purchase practice is included in the 'urf shahih, namely 'urf which is in accordance with Islamic law. In terms of sharia economic law, the practice of cutting the weight of the scales in buying and selling grain in Bumi Agung Wates Village, Bahuga Subdistrict, Way Kanan Regency, is valid because it fulfills the pillars and conditions of buying and selling in Islam.
