Abstract

ABSTRAK Adapun Judul tesis adalah Tinjauan Hukum Keluarga Islam Terhadap Implementasi He For She Dalam Perlindungan Perempuan (Di Dinas Pemberdayaan Perempuan Dan Perlindungan Anak (PPPA) Provinsi Sumatera Selatan ). He For She mengundang laki-laki dari segala usia sebagai mitra setara dalam membangun gerakan hak-hak perempuan dan menerapkan visi bersama tentang kesetaraan gender yang bermanfaat bagi seluruh umat manusia. Kampanye tersebut berupaya untuk melibatkan secara aktif laki-laki dan anak laki-laki dalam sebuah gerakan yang awalnya dipahami sebagai “perjuangan perempuan oleh perempuan”. Permasalahan yang diangkat adalah pertama, peran kampanye He For She dalam melindungi perempuan di masyarakat Palembang. Kedua, tinjauan hukum Islam atas kampanye He For She. peranannya dalam perlindungan perempuan dalam masyarakat. Jenis penelitian ini adalah Penelitian an ini termasuk todalam penelitian deskriptif kualitatif merupkan penelitian yang digun akan mengkaji kondisi objek ilmiah, dimana peneliti sebagai instrumen kunci,teknik pengumpulan data dilakukan dalam kombinasi, analisis data induktif dan hasil penelitian kualitatif lebih menekankan makna daripada generalisasi. Dari hasil penelitian ini dapat disimpulkan bahwa 1. Dinas Pemberdayaan Perempuan dan Perlindungan Anak Sumatera Selatan turut berkomitmen terhadap pencapaian kesetaraan gender melalui Kampanye He For She yang diwujudkan melalui Implementasi Konsep He For She di Indonesia untuk mendukung dan mencapai kesetaran gender yang berbentuk pelatihan, sosialiasi dan edukasi yang ditujukan kepada masyarakat, pekerja dan mahasiswa. Salah satu kegiatan nya yaitu kegiatan Peningkatan Kesadaran Terhadap Laki-Laki dan Perempuan tentang Gerakan Perempuan Cerdas Sriwijaya (GPCS) pemerintah berharap bahwa masyarakat dapat memiliki gambaran terkait dengan kedulian hak�hak perempuan dengan mengetahui komponen apa saja yang masih belumbaik bahkan indikator mana yang masih kurang baik. Sedangkan, Pembahasan maslahat di atas maka dapat disimpulkan bahwa perlindungan perempuan termasuk dalam maslahat Al-dharuriyah yaitu usaha dalam melindungi kaum perempuan, perempuan sangat memerlukan perlindungan tersebut untuk menjalankan hak dan kewajiban sebagaimana mestinya. Kebijakan yang maslahah haruslah sesuai dengan tujuan Hukum Islam, yaitu tidak boleh bertentangan dengan Al-Quran dan Assunah serta sesuai dengan tujuan Hukum Islam yaitu al-maqāṣid al-syar‟ah, menurut peneliti agar tepat dan sesuai maka dalam pendapatnya pengkajian al-maqāṣid atau tujuan hukum islam yang telah dijelaskan dalam al-maqāṣid yang universal atau luas sebagai upaya-upaya pembangunan dan merealisasikan hak asasi manusia pada zaman modern dan tentunya lebih dapat menjadi landasan ijtihad kontemporer bertujuan sebagai ḥifẓ al-huqūqu al-insan, yaitu sebagai bentuk dari perlindungan atas hak-hak manusia dimana negara wajib menjaga dan memberikan hak-hak dan perlindungannya kepada warga negaranya. Sebagai ḥifẓ al-„aql yaitu bentuk dari penjagaan atas hak masyarakat baik laki-laki maupun perempuan untuk mendapatkan pendidikan yang layak agar terhindar dari kebodohan. Keywords: He For She, Society, Maslahah Mursalah v ABSTRACT The title of the thesis is Islamic Family Law Review of the Implementation of He For She in the Protection of Women (At the Office of Women's Empowerment and Child Protection (PPPA) of South Sumatra Province). He For She invites men of all ages as equal partners in building a women's rights movement and implementing a shared vision of gender equality that benefits all humanity. The campaign seeks to actively engage men and boys in a movement originally conceived as a "women's struggle by women". The issues raised are first, the role of the He For She campaign in protecting women in Palembang society. Second, the review of Islamic law on the He For She campaign. its role in the protection of women in society. This type of research is descriptive qualitative research which is used to examine the conditions of scientific objects, where the researcher is the key instrument, data collection techniques are carried out in combination, inductive data analysis and qualitative research results emphasize meaning rather than generalization. From the results of this study it can be concluded that The South Sumatra Women's Empowerment and Child Protection Office is also committed to achieving gender equality through the He For She Campaign which is realized through the Implementation of the He For She Concept in Indonesia to support and achieve gender equality in the form of training, socialization and education aimed at the community, workers and students. One of the activities is raising awareness of men and women about the Sriwijaya Smart Women's Movement (GPCS). The government hopes that the community can have an overview related to the care of women's rights by knowing what components are still not good and even which indicators are still not good. Meanwhile, the discussion of maslahat above can be concluded that the protection of women is included in Al-dharuriyah maslahat, namely efforts to protect women, women really need this protection to carry out their rights and obligations as they should. A maslahah policy must be in accordance with the objectives of Islamic Law, which must not conflict with the Al-Quran and Assunah and in accordance with the objectives of Islamic Law, namely al-maqāṣid al-syar'ah, According to the researcher, in order to be precise and appropriate, in his opinion, the study of al-maqāṣid or the objectives of Islamic law which have been explained in al�maqāṣid which is universal or broad as an effort to develop and realize human rights in modern times and certainly more able to become the basis for contemporary ijtihad aims as ḥifẓ al-huqūqu al-insan, namely as a form of protection of human rights where the state is obliged to protect and provide its rights and protection to its citizens. Keywords: He For She, Society, Maslahah Mursalah. vi الملخص عنوان األطروحة ىو "استعراض قانون األسرة اإلسالمي لتنفيذ برنامج "ىو من أجلها" في حماية المرأة )في مكتب تمكين المرأة وحماية الطفل في مقاطعة سومطرة الجنوبية(. تدعو حملة "ىو من أجلها" الرجال من جميع األعمار كشركاء متساوين في بناء حركة حقوق المرأة وتنفيذ رؤية مشتركة للمساواة بين الجنسين تعود بالنفع على البشرية جمعاء. وتسعى الحملة إلى إشراك الرجال والفتيان بنشاط في حركة ُصممت في األصل على أنها "نضال نسائي من قبل النساء". القضايا المطروحة ىي أوال،ً دور حملة "ىو من أجله ا، مراجعة الشريعة اإلسالمية لحملة "ىو من أجلها" ً ا" في حماية المرأة في مجتمع بالمبانغ. ثاني ودورىا في حماية المرأة في المجتمع. ىذا النوع من البحوث ىو البحث الوصفي النوعي الذي يستخدم لفحص ظروف األشياء العلمية، حيث يكون الباحث ىو األداة الرئيسية، ويتم تنفيذ تقنيات جمع البيانات مجتمعة، وتحليل البيانات االستقرائية، وتؤكد نتائج البحوث النوعية على المعنى بدالً من التعميم. من نتائج ىذه الدراسة يمكن استنتاج ما يلي: يلتزم مكتب تمكين المرأة وحماية الطفل في جنوب سومطرة بتحقيق المساواة بين الجنسين من خالل حملة "ىو من أجلها" التي تتحقق من خالل تنفيذ مفهوم "ىو من أجلها" في إندونيسيا لدعم وتحقيق المساواة بين الجنسين في شكل تدريب وتنشئة اجتماعية وتثقيف يستهدف المجتمع والعاملين والطالب. ويتمثل أحد األنشطة في توعية الرجال والنساء بحركة سريويجايا النسائية الذكية .(GPCS (ومن ثم فإن الحكومة تأمل أن يكون لدى المجتمع نظرة عامة فيما يتعلق برعاية حقوق المرأة من خالل معرفة العناصر التي ال تزال غير جيدة وحتى المؤشرات التي ال تزال غير جيدة. وفي الوقت نفسو، يمكن أن نستنتج من مناقشة المصلحـــة أعاله أن حماية المرأة تدخل في المصلحـــة الظاىريـــة أي الجهود المبذولة لحماية المرأة، فالمرأة بحاجة ماسة إلى ىذه الحماية لتقوم بحقوقها وواجباتها كما ينبغي. أن سياسة المصلحـة يجب أن تكون وفق مقاصد الشريعة اإلسالمية التي يجب أن ال تتعارض مع الكتاب والسنة، ووفق مقاصد الشريعة اإلسالمية التي ىي مقاصد الشريعة اإلسالمية وىي مقاصد الشريعة اإلسالمية - حسب رأي الباحث - حتى تكون دقيقة ومناسبة في رأيو, فإن دراسة المقاصد أو مقاصد الشريعة ً لتطوير وإعمال اإلسالمية التي تم شرحها في المقاصد التي ىي شاملة أو واسعة النطاق، باعتبارىا جهدا ً لالجتهاد المعاصر الذي حقوق اإلنسان في العصر الحديث، و ىي بالتأكيد أقدر على أن تكون أساسا يهدف إلى حماية حقوق اإلنسان التي تلتزم الدولة بحمايتها وتوفير حقوقها وحمايتها لمواطنيها. وكشفع العقل، وىو شكل من أشكال حماية حقوق كل من الرجل والمرأة في الحصول على التعليم المناسب لتجنب الجهل. كلمات مفتاحية : ىو لـ ىي، مجتمع، مسلة مرسلة
