Abstract

ABSTRAK Dalam praktik sewa-menyewa sangat diperlukan akad yang jelas agar tidak ada perselisihan dipertengahan penyewaan sehingga saling memberikan manfaat dan tidak ada pihak yang dirugikan. Tidak dapat dipungkiri bahwasanya transaksi sewa-menyewa sudah biasa dilakukan dimasyarakat dan objek sewa menyewa pun kini sangat beragam contohnya yaitu sewa menyewa lightstick. Pada transaksi sewa menyewa lightstick ini umumnya menggunakan sistem deposit yang bertujuan untuk menghindari hal – hal yang tidak diinginkan mengingat harga lightstick yang relatif mahal dan juga pembeliannya yang cukup terbilang agak susah karena harus dikirim langsung dari negeri gingseng alias Korea Selatan. Dengan demikian, karena penggunaan sistem deposit tersebut maka jika barang sewaan terdapat kerusakan maka deposit fee tersebut akan hangus. Dalam hal ini yang menjadi permasalahan ialah ketentuan kerusakan pada perjanjian sewa menyewa tidak jelas sehingga berkemungkinan akan merugikan pihak penyewa apalagi terkadang ada jumlah deposit fee yang jumlahnya jika dijumlahkan dengan uang sewa maka jumlahnya bisa setara atau bahkan lebih dari harga lightstick dalam kondisi baru. Rumusan masalah penelitian adalah bagaimana praktik sewa menyewa lightstick dengan sistem deposit fee yang terjadi pada komunitas penggemar lightstick di Bandar Lampung dan bagaimana analisis hukum ekonomi syariah tentang praktik sewa menyewa lightstick dengan sistem deposit fee yang terjadi pada komunitas penggemar lightstick Bandar Lampung. Tujuan dalam penelitian ini adalah untuk mengetahui praktik sewa menyewa lightstick yang terjadi pada komunitas penggemar lightstick Bandar Lampung dan untuk mengetahui analisis hukum ekonomi syariah tentang praktik sewa menyewa lightstick yang terjadi pada komunitas penggemar lightstick Bandar Lampung.Penelitian ini termasuk jenis penelitian lapangan (field research), yaitu riset yang bersumber langsung pada penggemar lightstick dengan menggunakan metode wawancara (interview) yang dilakukan dengari cara tanya jawab dengan responden secara offline dan online serta dokumentasi yang diperoleh dari buku-buku, dokumen atau arsip yang menunjang penelitian. Hasil dari penelitian ini menyatakan bahwa penggunaan uang jaminan atau deposit fee pada Komunitas Penggemar Lightstick Bandar Lampung hukumnya boleh atau sah karna sudah sesuai dengan syarat yang berlaku.Segala sesuatu yang berdasarkan kesepakatan bersama maka hukumnya boleh karena salah satu syarat sewa menyewa ialah kedua belah pihak yang melakukan akad menyatakan kerelaannya untuk melakukan akad Ijārah itu.Selain itu juga, penggunaan sistem deposit fee ini bertujuan untuk menghindari terjadinya sesuatu yang tidak diinginkan sehingga merugikan salah satu pihak. ABSTRACT In the practice of leasing, a clear contract is very necessary so that there are no disputes in the middle of the rental so that mutual benefits are provided and no party is harmed. It cannot be denied that rental transactions are commonly carried out in society and rental objects are now very diverse, for example renting light sticks. Lightstick rental transactions generally use a deposit system which aims to avoid undesirable things considering that the price of lightsticks is relatively expensive and also purchasing them is quite difficult because they have to be sent directly from the country of ginseng, aka South Korea. Thus, due to the use of this deposit system, if the rental item is damaged, the deposit fee will be forfeited. In this case, the problem is that the damage provisions in the rental agreement are not clear, so it is likely to be detrimental to the renter, especially since sometimes there is a deposit fee, the amount of which, if added up to the rent, can be equal to or even more than the price of the light stick in new condition. The formulation of the research problem is how the practice of renting lightsticks with a deposit fee system occurs in the lightstick fan community in Bandar Lampung and what is the sharia economic law analysis of the practice of renting lightsticks with a deposit fee system that occurs in the lightstick fan community in Bandar Lampung. The aim of this research is to find out the practice of renting lightsticks that occurs in the Bandar Lampung lightstick fan community and to find out the sharia economic law analysis of the practice of renting lightsticks that occurs in the Bandar Lampung lightstick fan community. This research is a type of field research. , namely research that originates directly from lightstick fans using the interview method which is carried out by listening to questions and answers with respondents offline and online as well as documentation obtained from books, documents or archives that support the research. The results of this research state that the use of security deposits or deposit fees in the Bandar Lampung Lightstick fan community is legally permissible or legal because it is in accordance with the applicable conditions. Anything that is based on a mutual agreement is permissible because one of the conditions of renting is that both parties agree. carrying out the contract expresses his willingness to carry out the Ijārah contract. Apart from that, the use of this deposit fee system aims to avoid something undesirable happening that is detrimental to one of the parties. Keywords: Rent, Lightstick, Deposit Fee.
