Abstract

ABSTRAK Negara Indonesia merupakan negara hukum sebagaimana yang tertuang dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sehingga Negara memiliki kewajiban untuk menjaga setiap warga negaranya dan setiap warga negara memiliki kewajiban untuk mematuhi hukum yang telah berlaku di Indonesia. Setiap warga negara yang tidak mematuhi hukum dapat mengakibatkan dampak negatif terutama terkait dengan peningkatan tindak pidana yang dapat meresahkan masyarakat salah satunya adalah kasus kecelakaan kendaraan bermotor. Maka penulis tertarik untuk membahas bagaimana Implementasi Peraturan Menteri Perhubungan tentang Larangan Merokok Saat Mengendarai Kendaraan Bermotor Perspektif Fiqh Siyasah. Rumusan masalah dalam penelitian ini adalah: 1) Bagaimana Implementasi Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 tentang Larangan Merokok Saat Mengendarai Kendaraan Bermotor di Kota Bandar Lampung? 2) Bagaimana pandangan Fiqh Siyasah terhadap Implementasi Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 tentang Larangan Merokok Saat Mengendarai Kendaraan Bermotor?. Adapun tujuan dalam penelitian ini adalah sebagai berikut: 1) Untuk mengetahui Implementasi Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 tentang Larangan Merokok Saat Mengendarai Kendaraan Bermotor di Kota Bandar Lampung. 2) Untuk mengetahui pandangan Fiqh Siyasah terhadap Implementasi Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 tentang Larangan Merokok Saat Mengendarai Kendaraan Bermotor. Penelitian ini Jenis penelitian ini adalah penelitian lapangan (field research) yang bertujuan untuk mempelajari realia merokok dala keadaan berkendara sera larangannya di wilayah hukum bandar lampung. Adapun data-data lapangan adalah data-data yang berkaitan dengan Perlindungan Keselamatan Pengguna Sepeda Motor yang Digunakan Untuk Kepentingan Masyarakat di Kota Bandar Lampung. iii Berdasarkan hasil penelitian dapat disimpulkan bahwa: Implementasi Pasal 6 huruf c Peraturan Menteri Perhubungan Nomor Pm 12 tahun 2019 tentang Pelindungan Keselamatan Pengguan Sepeda Motor telah dilaksanakan dengan baik, para penegak hukum melakukan sosialisasi dengan masyarakat dan pengemudi terhadap aturan yang berlaku serta menjelaskan sanksi yang dapat diterima oleh pelaku pelanggaran apabila tetap melakukan pelanggaran. Namun, Masyarakat masih belum peduli dan memperhatikan tentang bahaya merokok saat berkendara. Pada wawancara menunjukan bahwa respoden telah mengetahui peraturan keselamatan dan keamanan berkendara (larangan merokok saat berkendara). Dalam implementasinya perspekif fiqh siayasah dusturiyah terhadap Eksistensi Pasal 6 huruf c sudah sesuai dangan hukum Islam, yang mana setiap peraturan yang dibuat untuk mencari kemaslahatan yang mutlak bagi masyarakat, setiap aturan tersebut tidak boleh menimbulkan kesulitan tetapi harus mendatangkan kemudahan bagi masyarakat seperti masyarakat harus mematuhi Peraturan Menteri Perhubungan Nomor Pm 12 Tahun 2019 tentang Pelindungan Keselamatan Pengguna Sepeda Motor yang Digunakan Untuk Kepentingan Masyarakat. iv ABSTRACT Indonesia is a legal state as stated in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia so that the State has an obligation to protect every citizen and every citizen has an obligation to obey the laws that apply in Indonesia. Every citizen who does not comply with the law can have negative impacts, especially related to an increase in criminal acts that can disturb the community, one of which is motor vehicle accidents. So the author is interested in discussing how to implement the Minister of Transportation's Regulation on the Prohibition of Smoking When Driving a Motorized Vehicle from a Fiqh Siyasah Perspective. The formulation of the problem in this research is: 1) How is the Implementation of Minister of Transportation Regulation Number 12 of 2019 concerning the Prohibition of Smoking While Driving Motorized Vehicles in Bandar Lampung City? 2) What is Fiqh Siyasah's view of the Implementation of Minister of Transportation Regulation Number 12 of 2019 concerning the Prohibition of Smoking While Driving Motorized Vehicles? The objectives of this research are as follows: 1) To determine the implementation of Minister of Transportation Regulation Number 12 of 2019 concerning the Prohibition of Smoking While Driving Motorized Vehicles in Bandar Lampung City. 2) To find out the view of Fiqh Siyasah regarding the Implementation of Minister of Transportation Regulation Number 12 of 2019 concerning the Prohibition of Smoking While Driving Motorized Vehicles. This research type of research is field research which aims to study the reality of smoking while driving and its prohibition in the jurisdiction of Bandar Lampung. The field data is data related to the safety protection of motorbike users used for the benefit of the community in the city of Bandar Lampung. Based on the results of the research, it can be concluded that: The implementation of Article 6 letter c of the Minister of Transportation Regulation Number Pm 12 of 2019 concerning Safety Protection for Motorcycle Users has been implemented well, law enforcers carry out socialization with the public and drivers regarding the applicable rules and explain the sanctions that can be v accepted by the perpetrator of the violation if he continues to commit the violation. However, people still don't care or pay attention to the dangers of smoking while driving. The interview showed that the respondent was aware of driving safety and security regulations (prohibition of smoking while driving). In its implementation, the fiqh siayasah dusturiyah perspective on the existence of Article 6 letter c is in accordance with Islamic law, where every regulation is made to seek absolute benefit for the community, each regulation must not cause difficulties but must bring convenience to the community as the community must comply with the regulations.
