Abstract

ABSTRAK Pernikahan ialah ikatan lahir dan batin antara seseorang pria dengan wanita sebagai suami isteri. Tradisi penjemputan calon pengantin laki-laki sebagai syarat sebelum ijab kabul sangatlah berkaitan dengan hukum perkawinan dan merupakan pembahasan hukum perkawinan Islam. Hal tersebut tentu menarik untuk dikaji lebih mendalam, dengan mengingat ketentuan tentang syarat dapat dilakukannya pernikahan tidak mengatur tentang penjemputan calon pengantin laki-laki sebelum ijab kabul. Permasalahan dalam skripsi ini adalah 1. Bagaimana praktek tradisi penjemputan calon pengantin laki-laki oleh keluarga calon pengantin perempuan sebagai syarat ijab kabul di Pekon Tanjung Jati Kecamatan Pesisir Selatan Kabupaten Pesisir Barat?. 2. Bagaimana analisis hukum Islam terhadap tradisi penjemputan calon pengantin laki-laki oleh keluarga calon pengantin perempuan sebagai syarat ijab kabul di Pekon Tanjung Jati Kecamatan Pesisir Selatan Kabupaten Pesisir Barat?. Tujuan penulis penelitian dalam skripsi ini yaitu untuk mengetahui tradisi penjemputan calon pengantin laki-laki oleh keluarga calon pengantin perempuan dan ingin mengetahui analisis hukum Islam terhadap tradisi penjemputan calon pengantin laki-laki oleh keluarga calon pengantin perempuan sebagai syarat ijab kabul di Pekon Tanjung Jati Kecamatan Pesisir Selatan Kabupaten Pesisir Barat. Penelitian ini termasuk jenis penelitian lapangan (field research) yang bersifat deskriptif analisis. Untuk mendapatkan data yang valid, sumber data penelitian ini yaitu, sumber data primer dan sumber data sekunder. Metode pengumpulan data didapat dari wawancara (interview), observasi, dan dokumentasi. Informan adalah teknik yang digunakan dalam pemilihan yang langsung dari narasumber. Setelah data terkumpul maka dilakukan analisis data, menggunakan metode kualitatif dan berfikir induktif. Hasil penelitian ini adalah praktek tradisi penjemputan calon pengantin laki-laki oleh keluarga calon pengantin perempuan sebagai syarat ijab kabul di Pekon Tanjung Jati Kecamatan Pesisir Selatan Kabupaten Pesisir Barat merupakan prosesi yang harus dilakukan sebelum ijab kabul dilaksanakan, yakni keluarga calon pengantin perempuan menjemput calon pengantin laki-laki beserta keluarganya ketika hendak iii melaksananakan ijab kabul. Jika tidak ada penjemputan maka calon pengantin laki laki tidak akan berangkat untukmelaksanakan ijab kabu l, dan hal itu berakibat pada batalnya nikah. Jika tradisi ini jika dilang gar selain mengakibatkan tertundanya dan tidak dapat dilangsungkan perkawinan, juga mendapatkan sanksi berupa cemoohan dan dikucilkan. Dalam analisis hukum Islam ini dianggap baik karena dapat memberikan kemaslahatan, tetapi tradisi tersebut tidak dapat dijadikaan sebagai syarat sah dan diterimanya pernikahan karena bertentangan dengan ketentuan pernikahan dalam hukum Islam. The tradition of picking up the prospective groom as a condition before the marriage ceremony is closely related to marriage law and is a discussion of Islamic marriage law. This is certainly interesting to study in more depth, bearing in mind that the provisions regarding the conditions for marriage to take place do not regulate the pick-up of the prospective groom before the marriage ceremony. The problems in this thesis are 1. What is the practice of the tradition of picking up the prospective groom by the prospective bride's family as a condition for the marriage contract in Pekon Tanjung Jati, Pesisir Selatan District, Pesisir Barat Regency? 2. What is the Islamic law analysis of the tradition of picking up the prospective groom by the prospective bride's family as a condition for the marriage contract in Pekon Tanjung Jati, Pesisir Selatan District, Pesisir Barat Regency? The aim of the research writer in this thesis is to find out the tradition of picking up the prospective bridegroom by the prospective bride's family and want to know the Islamic legal analysis of the tradition of picking up the prospective groom by the prospective bride's family as a condition for the marriage contract in Pekon Tanjung Jati, Pesisir District. South Pesisir Barat Regency. This research is a type of field research which is descriptive analysis. To obtain valid data, the data sources for this research are primary data sources and secondary data sources. Data collection methods are obtained from interviews, observation, and documentation. Informants are techniques used in direct selection of sources. After the data is collected, data analysis is carried out, using qualitative methods and inductive thinking. The results of this research are the traditional practice of picking up the prospective bridegroom by the prospective bride's family as a condition for the marriage contract in Pekon Tanjung Jati, Pesisir Selatan District, Pesisir Barat Regency, a procession that must be carried out before the marriage ceremony is carried out, namely the family of the prospective bride picks up the prospective bridegroom. -men and their families when they want to carry out the marriage vows. If there is no v pick-up, the groom-to-be will not go to carry out the marriage vows, and this will result in the marriage being annulled. If this tradition is violated, not only will it result in the marriage being delayed and not being able to take place, it will also result in sanctions in the form of ridicule and ostracism. In the analysis of Islamic law, this is considered good because it can provide benefits, but this tradition cannot be used as a condition for the validity and acceptance of marriage because it is contrary to the provisions of marriage in Islamic law.
