Abstract

ABSTRAK Upah dalam hukum Islam termasuk kedalam bab ijarah dengan syarat bahwa akad ijarah yang dilakukan harus jelas. Penelitian ini membahas bagaimana kesesuaian praktik pemberian upah pengurus panti asuhan Husnul Khotimah Lampung. Pemberian upah kepada pengurus dilakukan sesuai dengan kesepakatan yang telah dibuat oleh beberapa pengurus dan pemilik panti asuhan Husnul Khotimah Lampung. Apakah dengan kesepakatan yang telah terlaksana tersebut sesuai dengan Ijarah, karena dalam kewajiban membayar upah pengurus terdapat perbedaan dari kesepakatan yang telah dibuat. Rumusan masalah pada penelitian ini adalah bagaimana praktik pembayaran upah kepada pengurus panti asuhan Husnul Khotimah Lampung dan Bagaimana Tinjauan Hukum Islam Terhadap Praktik Pemberian Upah Kepada Pengurus Panti Asuhan Husnul Khotimah Lampung. Penelitian ini menggunakan jenis penelitian lapangan (field reseacrh), yaitu suatu penelitian yang meneliti obyek dilapangan untuk men dapatkan data dan gambaran yang jelas serta konkrit tentang hal-hal yang berhubungan dengan permasalahan yang diteliti. Penelitian ini menggunakan pendekatan kualitatif deskriptif. Sumber data yang digunakan adalah sumber data primer dari wawancara langsung dan sumber data sekunder adalah sumber data pendukung yang berhubungan dengan permasalahan yang diteliti. Hasil penelitian dan analisa menunjukan bahwa praktik pemberian upah kepada pengurus panti asuhan Husnul Khotimah Lampung dilakukan setiap hari sesuai dengan kesepakatan yang telah dibuat dimana memberikan upah sebesar Rp.70.000,00- (Tujuh Puluh Ribu Rupiah) apabila pendapatan panti dibawah Rp.1.500.000,00- (Satu Juta Lima Ratus Ribu Rupiah) dan Rp.100.000,00- (Seratus Ribu Rupiah) apabila pendapatan panti lebih dari Rp.1.500.000,00- (Satu Juta Lima Ratus Ribu Rupiah), semula pemberian upah sesuai dengan perjanjian namun ketika terjadi wabah Covid-19 pemberian upah berbeda hingga saat ini. dan menurut hukum Islam pemberian upah kepada pengurus panti asuhan Husnul Khotimah Lampung tidak sesuai dengan akad ijarah karena tidak terpenuhi salah satu rukun upah. This research discusses the appropriateness of the practice of paying salaries to the administrators of the Husnul Khotimah Lampung orphanage. Remuneration to administrators is carried out in accordance with the agreement made by several administrators and owners of the Husnul Khotimah Lampung orphanage. Is the agreement that has been implemented in accordance with the Ijarah, because in the obligation to pay administrators' wages there are differences from the agreement that has been made? The formulation of the problem in this research is the practice of paying wages to the administrators of the Husnul Khotimah Lampung orphanage and how Islamic law reviews the practice of paying wages to the administrators of the Husnul Khotimah Lampung orphanage. This research uses a type of field research, namely research that examines objects in the field to obtain data and a clear and concrete picture of matters related to the problem being studied. This research uses a descriptive qualitative approach. The data sources used are primary data sources from direct interviews and secondary data sources are supporting data sources related to the problems. The results of the research and analysis show that the practice of giving wages to the administrators of the Husnul Khotimah Lampung orphanage is carried out every day in accordance with the agreement that has been made which provides wages of IDR 70,000.00- (Seventy Thousand Rupiah) if the orphanage's income is below IDR 1,500. 000.00- (One Million Five Hundred Thousand Rupiah) and Rp. 100,000.00- (One Hundred Thousand Rupiah) if the orphanage's income is more than Rp. 1,500,000.00- (One Million Five Hundred Thousand Rupiah), initially the wages are given according to with an agreement but when the Covid-19 outbreak occurred the wages were different until now. and according to Islamic law, giving wages to the administrators of the Husnul Khotimah Lampung orphanage is not in accordance with the ijarah agreement because one of the pillars of wages is not fulfilled.
