Abstract

ABSTRAK Sebagai kaum yang menyandang keterbatasan, penyandang disabilitas kerap dikesampingkan keberadaan serta haknya karena dianggap memiliki keterbatasan secara fisik, mental maupun sensorik. Padahal Undang-Undang Dasar Tahun 1945 sebagai konstitusi Indonesia sangat menjunjung keadilan, bahkan kesetaraan hak tanpa membeda-bedakan bentuk fisik, ras, budaya, suku maupun agama. Setiap manusia memiliki hak, kewajiban serta kedudukan yang sama di mata hukum termasuk penyandang disabilitas. Dengan itu, pemerintah membentuk Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 Tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas untuk mewujudkan kesetaraan hak bagi penyandang disabilitas, salah satu hak yang terdapat dalam Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 Tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas yaitu di bidang politik terkait pendidikan politik pada Pasal 62. Kesbangpol dalam hal ini menjadi salah satu instansi yang berwenang karena memiliki fungsi dalam pembinaan dan pelaksanaan di bidang politik dalam negeri. Sehingga rumusan masalah dalam penelitian ini adalah bagaimana Implementasi Pasal 62 Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 Tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas dalam memberikan fasilitas pendidikan politik oleh Kesbangpol Provinsi Lampung dan bagaimana Fikih Siyasah memandang Permasalahan tersebut. Penelitian ini menggunakan metode kualitatif, karena penulis ingin menyampaikan dengan cara menggambarkan dan mendeskripsikan suatu permasalahan yang ada di lapangan. Jenis dari penelitian ini adalah penelitian lapangan atau field research, yaitu penelitian yang dilakukan dengan melihat secara dekat objek yang akan diteliti. Sehingga data yang digunakan adalah primer yang bersumber langsung dari data lapangan, serta data sekunder yaitu data pendukung yang berasal dari sumber-sumber berupa buku, jurnal, skripsi dan pendapat para ahli. Berdasarkan hasil penelitian yang dilakukan dapat disimpulkan bahwa Implementasi Pasal 62 Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 Tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas dalam bidang politik khususnya pendidikan politik tidak terlaksana karena pihak Kesbangpol belum memiliki program serta dana untuk penyandang disabilitas dalam mendapatkan fasilitas pendidikan politik dan hanya melakukan sosialisasi pendidikan politik kepada pemilih pemula. Sedangkan, Tinjauan Fikih Siyasah terhadap Implementasi Pasal 62 Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 Tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas tidak terlaksana, hal ini dibuktikan dengan siyasah tanfidziyyah atau penerapan Pasal 62 Peraturan Daerah Provinsi Lampung Nomor 10 Tahun 2013 Tentang Pelayanan dan Pemenuhan Hak-Hak Penyandang Disabilitas belum terpenuhi. Even though the 1945 Constitution as the Indonesian constitution really upholds justice, even equal rights without discriminating against physical form, race, culture, ethnicity or religion. Every human being has the same rights, obligations and position before the law, including people with disabilities. With that, the government formed Lampung Province Regional Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities to realize equal rights for people with disabilities, one of the rights contained in Lampung Province Regional Regulation Number 10 of 2013 concerning Services and Fulfillment of Rights. The rights of Persons with Disabilities, namely in the political field, are related to political education in Article 62. Kesbangpol in this case is one of the authorized agencies because it has a function in coaching and implementation in the field of domestic politics. So the formulation of the problem in this research is how to implement Article 62 of Lampung Province Regional Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities in providing political education facilities by Kesbangpol Lampung Province and how Fikih Siyasah views this problem. This research uses qualitative methods, because the author wants to convey by describing and describing a problem that exists in the field. This type of research is field research, namely research carried out by looking closely at the object to be studied. So the data used is primary which comes directly from field data, as well as secondary data, namely supporting data which comes from sources in the form of books, journals, theses and expert opinions. Based on the results of the research conducted, it can be concluded that the implementation of Article 62 of Lampung Province Regional Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities in the political field, especially political education, has not been implemented because the Kesbangpol does not yet have programs and funds for persons with disabilities to obtain facilities. political education and only disseminate political education to novice voters. Meanwhile, the Siyasah Fiqh Review of the Implementation of Article 62 of Lampung Province Regional Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities has not been implemented, this is proven by siyasah tanfidziyyah or the implementation of Article 62 of Lampung Province Regional Regulation Number 10 of 2013 concerning Services and Fulfillment of the Rights of Persons with Disabilities has not been fulfilled.
