Abstract

ABSTRAK Praktik jual beli handphone bekas melalui media sosial, seperti Facebook, telah menjadi populer dalam beberapa tahun terakhir. Kelebihannya adalah pembeli dapat memilih dan mendapatkan handphone dengan harga terjangkau, serta proses transaksi yang lebih mudah dan cepat. Terdapat permasalahan yang dilakukan oleh penjual yang tidak sesuai dengan hukum ekonomi syariah. Permasalahan yang terjadi seperti penjual yang melakukan kecurangan/penipuan terhadap pelanggan, seperti tidak jujur kepada pelanggan kondisi hp yang akan dijual seperti yang terjadi di dalam group facebook Bandar Jaya. Rumusan masalah dalam penelitian ini adalah bagaimana praktik jual beli Handphone bekas melalui media sosial grup facebook Bandar Jaya dan bagaimana tinjauan Hukum Ekonomi Syariah tentang jual beli Handphone bekas melalui media sosial grup facebook Bandar Jaya. Tujuan penelitian untuk mengetahui bagaimana praktik jual beli Handphone bekas melalui media sosial grup facebook Bandar Jaya dan Untuk mengetahui bagaimana tinjauan Hukum Ekonomi Syariah tentang jual beli Handphone bekas melalui media sosial grup facebook Bandar Jaya. Penelitian ini termasuk penelitian lapangan (field research) yang sifatnya deskriptif kualitatif, yaitu memaparkan dan menggambarkan praktik jual beli Handphone bekas melalui grup jual beli hp bekas Bandar Jaya di Facebook. Teknik pengumpulan data yang dilakukan yaitu wawancara, observasi, dan dokumentasi. Metode pengumpulan data dengan wawancara dan dokumentasi. Teknik pengolahan data dilakukan dengan cara pemeriksaan data (edting) dan sistematika. Sedangkan analisa data dilakukan dengan cara kualitatif yaitu reduksi data, menyajikan data dan menarik kesimpulan. Berdasarkan analisis praktik jual beli handphone bekas melalui media sosial Facebook pada grup jual beli hp bekas Bandar Jaya, dapat disimpulkan bahwa transaksi tersebut dapat dilakukan dengan memperhatikan prinsip-prinsip hukum ekonomi syariah. Dalam praktik jual beli Handphone bekas melalui grup Facebook jual beli hp bekas Bandar Jaya, terdapat transaksi yang dilakukan dengan jual beli, barter, atau tukar tambah yang sesuai. Transaksi tersebut dilakukan dengan kesepakatan sukarela antara penjual dan pembeli, tanpa adanya unsur paksaan dari pihak lain. Meskipun terdapat kecurangan atau penipuan yang terkadang terjadi dalam praktik jual beli Handphone bekas melalui media sosial, hal tersebut bukanlah hal yang diinginkan atau diterima dalam Islam. Tidak semua pembeli rela atas kecurangan tersebut, ada beberapa pembeli tidak rela sehingga menjadikan jual beli tersebut tidak sah. Prinsip-prinsip hukum ekonomi syariah mendorong integritas, kejujuran, dan keterbukaan dalam setiap transaksi. The advantage is that buyers can choose and get a cellphone at an affordable price, and the transaction process is easier and faster. There are problems carried out by sellers that are not in accordance with sharia economic law. Problems that occur include sellers cheating/defrauding customers, such as not being honest with customers about the condition of the cellphone they are selling, as happened in the Bandar Jaya Facebook group. The formulation of the problem in this research is the practice of buying and selling used cellphones through the Bandar Jaya Facebook group social media and how Sharia Economic Law reviews the buying and selling of used cellphones through the Bandar Jaya Facebook group social media. The aim of the research is to find out how the practice of buying and selling used cellphones through the Bandar Jaya Facebook group social media and to find out how Sharia Economic Law reviews the buying and selling of used cellphones through the Bandar Jaya Facebook group social media. This research includes field research which is descriptive qualitative in nature, namely explaining and describing the practice of buying and selling used cellphones through the Bandar Jaya used cellphone buying and selling group on Facebook. The data collection techniques used were interviews, observation and documentation. Data collection methods are interviews and documentation. Data processing techniques are carried out by examining data (edting) and systematics. Meanwhile, data analysis was carried out qualitatively, namely data reduction, presenting data and drawing conclusions.Based on an analysis of the practice of buying and selling used cellphones via Facebook social media in the Bandar Jaya used cellphone buying and selling group, it can be concluded that these transactions can be carried out by paying attention to the principles of sharia economic law. In the practice of buying and selling used cellphones through the Bandar Jaya used cellphone buying and selling Facebook group, there are transactions carried out by buying and selling, bartering or exchanging accordingly. The transaction is carried out with a voluntary agreement between the seller and the buyer, without any element of coercion from the other party. Even though there is cheating or fraud that sometimes occurs in the practice of buying and selling used cellphones via social media, this is not something that is desired or accepted in Islam. Not all buyers are willing to accept this fraud, some buyers are unwilling, making the sale and purchase invalid.
