Abstract

ABSTRAK Perangkat Desa sebagai salah satu unsur pelaku desa yang sangat memiliki peran penting tersendiri dalam mewujudkan kemajuan bangsa melalui desa. Adapun Perangkat Desa lainnya yang dimaksud biasanya jumlah dan sebutannya disesuaikan dengan kebutuhan dan kondisi sosial budaya masyarakat setempat yang biasa dikenal dengan sebutan Kepala Urusan (Kaur)/Kepala Seksi (Kasi) dan unsur kewilayahan/Kepala Dusun (Kadus) yang ada di setiap Pemerintahan Desa. Kabupaten Lampung Tengah membuat peraturan Pasal 2 Nomor 9 Tahun 2019 Tentang Perangkat Kampung, Susunan Organisasi dan Tata Kerja Pemerintah Kampung. Jenis penelitian ini adalah penelitian lapangan (Field Research). Sifat penelitian ini bersifat deskriptif analisis yaitu membuat deskritif, gambaran, atau lukisan secara sistematis dan objektif mengenai fakta�fakta, sifat-sifat tentang aturan perangkat desa. Penelitian ini bersumber dari data primer yang diperoleh melalui wawancara dan dokumentasi, sedangkan data sekunder diperoleh dengan mengadakan studi pustaka (library reseach). Dari hasil penelitian dapat disimpulkan bahwa: 1) Implementasi pengangkatan perangkat desa di Kampung Komering Putih belum sesuai dengan peraturan daerah yang telah ditetapkan pada Pasal 2 Nomor 9 Tahun 2019 tentang batasan umur sebagai persyaratan menjadi perangkat Kampung. Ada beberapa faktor yang menyebabkan perangkat desa tersebut tetap menjabat sebagai perangkat desa dikarenakan masih dipilihnya perangkat desa yang sudah melebihi batas usia dilihat dari segi kekerabatan dan pengetahuan adat istiadat kampungnya. Sehingga beberapa desa terpaksa tidak dapat mengikuti syarat yang terdapat dalam Pasal 2 Nomor 9 Tahun 2019 dan pemerintah setempat juga tidak mempermasalahkan hal tersebut walaupun tidak ada pertanggung jawaban dari pihak camat, namun mereka dipertanggung jawabkan oleh kepala desa masing-masing. 2) Perspektif fiqih siyāsah Tanfīdzīyyah pengangkatan perangkat di Kampung Komering Putih belum sesuai dengan fiqh siyāsah iii Tanfīdzīyyah tersebut karena telah dijelaskan bahwa dalam fiqh siyāsah Tanfīdzīyyah sendiri adalah pelaksanaan perundang-undangan yang dimana wajib dilaksanakan dan diikuti sesuai peraturan yang berlaku. Dalam Islam pemimpin sering merujuk pengertian Ulil Amri atau pejabat adalah orang yang mendapat amanah untuk mengurus urusan orang lain dan Khadmil Umat (pelayanan umat) dengan pengertian seorang pemimpin harus menempatkan diri pada posisi sebagai pelayan masyarakat. Sebagai kepala negara seharusnya bersifat adil. kepala negara yang adil adalah yang mengasihi rakyatnya, tidak menambah atau mengurangi hukuman yang semestinya, selalu menepati jalan kebenaran,memiliki rasa malu, murah hati, meluruskan bawahan yang berbuat zalim, tidak sombong dan pemarah. Kata Kunci : Implementasi, Pengangkatan Perangkat Desa, Fiqh Siyāsah. iv ABSTRACT Village apparatus as one of the elements of village actors who have a very important role in realizing the progress of the nation through the village. As for the other Village Officials referred to, the number and designations are usually adjusted to the needs and socio�cultural conditions of the local community, commonly known as the Head of Affairs (Kaur)/Head of Section (Kasi) and regional elements/Head of Hamlets (Kadus) in each Village Government. Central Lampung Regency made regulation Article 2 Number 9 of 2019 concerning Village Devices, Organizational Structure and Work Procedures of Village Government. This type of research is field research (Field Research). The nature of this research is descriptive analysis, namely making systematic and objective descriptions, descriptions, or drawings regarding facts, characteristics regarding village apparatus rules. This research was sourced from primary data obtained through interviews, observation, and documentation, while secondary data was obtained by conducting library research. From the results of the study it can be concluded that: 1) The implementation of the appointment of village officials in Komering Putih Village has not been in accordance with the regional regulations stipulated in Article 2 Number 9 of 2019 concerning the limit of education for village officials, at least the education strata of general high school graduates (SMU) and age limits. There are several factors that cause the village apparatus to continue to serve as village equipment due to the lack of education in the villages and the selection of village apparatus that has exceeded the limit because it is seen in terms of knowledge of village customs. So that some villages are forced to be unable to follow the conditions contained in Article 2 Number 9 of 2019 and the local government also does not mind this even though there is no responsibility from the sub-district, but they are accounted for by their respective village heads. v 2) The perspective of fiqh siyāsah Tanfīdzīyyah the appointment of devices in Kampung Komering Putih is not in accordance with the fiqh siyāsah Tanfīdzīyyah because it has been explained that in fiqh siyāsah itself is the im Tanfīdzīyyah plementation of legislation which must be implemented and followed in accordance with applicable regulations. In Islam, leaders often refer to the notion of Ulil Amri or an official is a person who gets the mandate to take care of the affairs of others and Khadmil Umat (service of the people) with the understanding that a leader must put himself in a position as a public servant. As head of state it should be fair. A just head of state is one who loves his people, does not increase or subtract due punishment, always keeps the path of righteousness, has shame, is generous, straightens out subordinates who commit tyranny, is not arrogant and angry.
