Abstract

ABSTRAK Jual beli merupakan suatu kegiatan ekonomi yang tidak lepas dari aktivitas transaksi guna memenuhi kebutuhan hidup. Jual beli dengan sistem kantongan yang terjadi di Kuala Stabas adalah suatu bentuk jual beli dimana seseorang membeli suatu barang yaitu dengan cara sipenjual mengambil barang dagangannya yang kemudian dimasukkan kedalam kantong plastik tanpa ditakar atau ditimbang terlebih dahulu, sehingga pembeli tidak mengetahui apakah sudah sesuai dengan timbangan yang diminta atau belum. Hal tersebut dapat membuat keraguan salah satu pihak bahkan dapat membuat salah satu pihak mengalami kerugian baik dari penjual ataupun pembeli, karena jual beli dengan sistem kantongan hanya menggunakan kantong dimana bisa saja penjual memberikan barang tersebut lebih banyak dari yang diminta pembeli maka akan menimbulkan kerugian bagi penjual itu sendiri, dan sebaliknya jika penjual mengambil dalam jumlah lebih sedikit dari yang diminta pembeli maka hal tersebut akan merugikan pihak pembeli. Rumusan masalah dalam penelitian ini adalah : 1) bagaimana praktik jual beli rumput laut dengan sistem kantongan di Kuala Stabas Kecamatan Pesisir Tengah Kabupaten Pesisir Barat, 2) bagaimana tinjauan hukum ekonomi syariah terhadap praktik jual beli rumput laut dengan sistem kantongan di Kuala Stabas Kecamatan Pesisir Tengah Kabupaten Pesisir Barat. Tujuan penelitian ini yaitu 1) untuk mengetahui jual beli rumput laut dengan sistem kantongan di Kuala Stabas Kelurahan Pasar Krui Kecamatan Pesisir Tengah Kabupaten Pesisir Barat, 2) untuk mengetahui tinjauan hukum ekonomi syariah terhadap praktik jual beli rumput laut dengan sistem kantongan di Kuala Stabas Kelurahan Pasar Krui Kecamatan Pesisir Tengah Kabupaten Pesisir Barat. Adapun jenis penelitian ini adalah penelitian lapangan (field research) yaitu suatu penelitian yang bertujuan untuk mengumpulkan data yang diperoleh dari lokasi penelitian dan bersifat deskriptif analisis, teknik pengumpulan data yang digunakan yaitu wawancara dan dokumentasi. Hasil penelitian yang didapat dalam penelitian ini adalah praktik jual beli rumput laut dengan sistem kantongan di Kuala Stabas Kelurahan Pasar Krui Kecamatan Pesisir Tengah Kabupaten Pesisir iv Barat merupakan jual beli menggunakan kantong dalam mengambil barang dagangannya, tanpa ditakar atau ditimbang terlebih dahulu. Jual beli rumput laut dengan sistem kantongan di Kuala Stabas sudah menjadi kebiasaan penjual dan sudah berlangsung sejak puluhan tahun yang lalu. Pada praktik jual beli rumput laut dengan sistem kantongan di Kuala Stabas diperbolehkan, karena adanya unsur kepercayaan dan keralaan di antara kedua belah pihak. Sedangkan berdasarkan tinjauan hukum ekonomi syariah terhadap jual beli rumput laut dengan sistem kantongan diperbolehkan atau sah yang didasari prinsip keadilan dan adanya kerelaan dari kedua belah pihak. Karena jual beli tersebut sudah memenuhi rukun dan syarat jual beli di mana pembeli dan penjual sama sama rela tanpa adanya unsur paksaan. The formulation of the problems in this study are: 1) what is the practice of buying and selling seaweed with a bag system in Kuala Stabas, Pesisir Tengah District, Pesisir Barat Regency, 2) what is the review of Islamic economic law on the practice of buying and selling seaweed with a bag system in Kuala Stabas, Pesisir Tengah District West Coast District. The aims of this study were 1) to find out the buying and selling of seaweed using the bag system in Kuala Stabas Pasar Krui Village, Pesisir Tengah District, Pesisir Barat Regency, 2) to find out the review of sharia economic law on the practice of buying and selling seaweed with the bag system in Kuala Stabas Pasar Village Krui, Central Coast District, West Coast District. The type of this research is field research, which is a study that aims to collect data obtained from research locations and is descriptive analysis in nature, the data collection techniques used are interviews and documentation. The research results obtained in this study are the practice of buying and selling seaweed with a bag system in Kuala Stabas, Pasar Krui Village, Pesisir Tengah District, Pesisir Barat Regency, which is buying and selling using bags to collect merchandise, without measuring or weighing it first. Buying and selling seaweed using a bag system in Kuala Stabas has become a seller's habit and has been going on for decades. The practice of buying and selling seaweed using the bag system in Kuala Stabas is permissible, because there is vi an element of trust and tolerance between the two parties. Meanwhile, based on a review of sharia economic law, the sale and purchase of seaweed using a bag system is permissible or legal based on the principles of justice and the willingness of both parties. Because the sale and purchase already fulfills the pillars and conditions of sale and purchase where the buyer and seller are both willing without any element of coercion.
