Abstract

ABSTRAK Lembaga Himpunan pekon (LHP) yang terdiri dari unsur tokoh agama, toko adat tokoh masayarakat dan toko pemuda, Lembaga Himpun Pemekon (LHP) memiliki peran strategis dalam mewujudkan terciptanya peningkatan kesejahteraan masyarakat Pekon, bersama dengan Kepala Pekon diharapkan bahwa peran Lembaga Himpun Pekon lebih nyata sebagai parlemen Pekon untuk melaksanakan tugas utama yaitu melaksanakan pembangunan Pekon serta musyawarah, mufakat dalam membuat peraturan dan pengambilan keputusan di pekon. Dalam upaya mewujudkan pelaksanaan demokrasi dalam penyelenggaraan Pemerintahan Desa agar mampu menggerakan masyarakat untuk berpartisipasi dalam pembangunan dan penyelenggaraan administrsi Pekon, maka setiap keputusan yang diambil harus berdasarkan musyawarah untuk mencapai mufakat. Rumusan masalah dalam penelitian ini adalah (1). Bagaimana Implementasi Pasal 38 Huruf c Peraturan Daerah Kabupaten Pesisir Barat Nomor. 17 Tahun 2016 Tentang Susunan Organisasi dan Tata Kerja Pemerintah Pekon Studi di Pekon Kebuayan Kabupaten Pesisir Barat, dan (2). Bagaimana Tinjauan Fiqh Siyasah Tanfidziyah. Terhadap Implementasi Pasal 38 Huruf c Peraturan Daerah Kabupaten Pesisir Barat Nomor. 17 Tahun 2016 Tentang Susunan Organisasi dan Tata Kerja Pemerintah Pekon Studi di Pekon Kebuayan Kabupaten Pesisir Barat. Sedangkan tujuan penelitian ini adalah: Untuk Mengetahui dan Mempelajari Implementasi Pasal 38 Huruf c Peraturan Daerah Kabupaten Pesisir Barat Nomor. 17 Tahun 2016 Tentang Susunan Organisasi dan Tata Kerja Pemerintah Pekon Studi di Pekon Kebuayan Kabupaten. Pesisir Barat, dan Untuk Mengetahui dan Mempelajari Tinjauan Fiqh Siyasah Tanfidziyah. Terhadap Implementasi Pasal 38 Huruf c Peraturan Daerah Kabupaten Pesisir Barat Nomor. 17 Tahun 2016 Tentang Susunan Organisasi dan Tata Kerja Pemerintah Pekon Studi di Pekon Kebuayan Kabupaten Pesisir Barat. Jenis Penelitian ini adalah penelitian lapangan (field research) sedangkan sifat penelitian yang digunakan adalah bersifat induktif analisis. Analisis data bersifat kualitatif yaitu suatu prosedur penelitian yang menghasilkan data berupa kata-kata tulisan atau lisan dari orang-orang yang dapat di mengerti. Implementasi Pasal 38 Huruf c Peraturan Daerah Kabupaten Pesisir Barat Nomor. 17 Tahun 2016 Tentang Susunan Organisasi dan iii Tata Kerja Pemerintah Pekon, Lembaga Himpunan pekon belum mampu secara maksimal dalam mengimplentasikan PERDA Kabupaten Pesisir Barat Nomor 17 Tahun 2016 Pasal 38 Huruf c dalam menjalankan tugas dan fungsi sebagai Lembaga Himpunan Pekon (LHP). Hal ini ditandai dengan pembangunan jalan rabat beton dan pembangunan irigasi sawah yang dibangun asal jadi diakibatkan kurangnya kesadaran terhadap tugas dan wewenang Lembaga Himpunan Pekon dalam mengawasi kinerja pemerintahan pekon. Menurut pandangan Fiah Siyasah Tanfidziyah yang merupakan tugas untuk melaksanakan undang-undang. Dalam prakteknya belum sesuai dalam Fiqh Siyasah Tanfdziyah yaitu belum terlaksananya tugas dan wewenang Lembaga Himpunan Pekon atau lembaga perwakilanrakyat di sebut dengan Ahl al-Hall Wa al-Aqd di Pekon Kebuayan Kabupaten Pesisir Barat, terdapat beberapa kendala yang menyebabkan pelaksanaan tersebut kurang efektif. iv ABSTRAK Pekon Association Institution (LHP) which consists of elements of religious leaders, traditional shops, community leaders and youth shops, Pemekon Association Institution (LHP) has a strategic role in realizing the creation of an increase in the welfare of the Pekon community, together with the Pekon Head it is hoped that the role of the Pekon Association Institution is more real as the Pekon parliament to carry out the main task of carrying out Pekon development as well as deliberations, consensus in making regulations and decision making in the Pekon. In an effort to realize the implementation of democracy in the implementation of Village Government so that it is able to mobilize the community to participate in the development and implementation of Pekon administration, every decision taken must be based on deliberation to reach a consensus. The formulation of the problem in this study is (1). How to Implement Article 38 Letter c Regional Regulation of Pesisir Barat Regency Number. 17 of 2016 concerning the Organizational Structure and Working Procedures of the Study Village Government in the Kebuayaan Pekon Pesisir Barat Regency, and (2). How to Review Fiqh Siyasah Tanfidziyah. While the purpose of this research is: To find out and be involved in the implementation of Article 38 Letter c Regional Regulation of Pesisir Barat Regency Number. 17 of 2016 concerning the Organizational Structure and Working Procedures of the Pekon Study Government in Pekon Kebuayaan Regency. Pesisir Barat, and To Know and be consumed by the Fiqh Review of Siyasah Tanfidziyah. Regarding the Implementation of Article 38 Letter c Regional Regulation of Pesisir Barat Regency Number. 17 of 2016 concerning the Organizational Structure and Working Procedures of the Study Village Government in the Kebuayaan Pekon Pesisir Barat Regency. This type of research is field research, while the nature of the research used is analytical inductive in nature. Data analysis is qualitative in nature, namely a research procedure that produces data in the form of written or spoken words from people who can be understood. v Implementation of Article 38 Letter c Regional Regulation of Pesisir Barat Regency Number. 17 of 2016 concerning the Organizational Structure and Working Procedures of the Pekon Government, the Pekon Association has not been able to optimally implement the Regional Regulation of Pesisir Barat Regency Number 17 of 2016 Article 38 Letter c in carrying out its duties and functions as a Pekon Association Institution (LHP). This is marked by the construction of concrete roadways and the construction of rice field irrigation which were built haphazardly due to a lack of awareness of the duties and authorities of the Pekon Association in supervising the performance of the village government. According to Fiah Siyasah Tanfidziyah's view, it is the duty to implement the law. In practice it is not appropriate in the Fiqh Siyasah Tanfdziyah, that is, the duties and powers of the Pekon Association or a people's representative body called Ahl al-Hall Wa al-Aqd have not been carried out in Kebuayan Pekon Pesisir Barat Regency, there are several obstacles that cause this implementation to be less effective
