Abstract

ABSTRAK Penelitian ini dilatar belakangi adanya praktik jual beli tanah di CV Hikmah Kabupaten Lampung Selatan. Dalam praktik jual beli, pemilik CV Hikmah membeli tanah kepada pemilik lahan dengan luas tanah ±3 Ha (Hektare) sebesar Rp. 296.000.000 (dua ratus sembilan puluh enam juta rupiah) dengan sistem jual beli kredit, pemilik CV Hikmah memiliki bukti berupa surat perjanjian jual beli dan kwitansi pelunasan, yang telah ditandatangani oleh kedua belah pihak namun pemilik lahan merasa bahwa pemilik CV Hikmah mengingkari perjanjian yang telah disepakati oleh ketiga belah pihak, sebab, pemilik CV Hikmah tidak melunasi kesepakatan harga tanah kepada pemilik lahan sehingga menimbulkan wanprestasi, kemudian, pemilik CV Hikmah telah melakukan jual beli tanah tersebut kepada para nasabahnya dengan sistem jual beli kredit dengan total 71 kavling tanah dari luas tanah ±3 Ha (Hektare) , sehingga menimbulkan kerugian kepada pembeli kavling tanah di CV Hikmah Kabupaten Lampung Selatan. Berdasarkan uraian tersebut, penulis tertarik untuk menganalisis secara hukum Islam, karena terdapat jual beli wanprestasi. Permasalahan penelitian ini antara lain : 1) Bagaimana tinjauan hukum Islam di Indonesia terhadap praktik dalam jual beli tanah di CV Hikmah Kabupaten Lampung Selatan? 2) Bagaimana penyelesaian praktik wansprestasi jual beli tanah di CV. Hikmah Kabupaten Lampung Selatan? Metode yang digunakan adalah kualitatif. Termasuk penelitian lapangan (field research) penelitian ini juga menggunakan literatur (kepustakaan) Hasil penelitian : praktik jual beli antara pemilik CV Hikmah dan pemilik lahan dilakukan dengan adanya perjanjian jual beli, dalam praktiknya pemilik lahan merasa bahwa pemilik CV Hikmah tidak melunasi harga sesuai dengan perjanjian jual beli (wanprestasi), sehingga pemilik lahan merasa dirugikan dan meminta kepada pemilik CV Hikmah untuk tidak melakukan transaksi jual beli di tanah tersebut, atas hal ini para nasabah CV Hikmah telah dirugikan oleh pemilik CV Hikmah sebab para nasabah telah membeli tanah tersebut dengan sistem jual beli kredit, dalam hukum Islam jika syarat dan rukun nya tidak terpenuhi maka jual beli tersebut batal dikarenakan objek barang (tanah) yang telah dijual oleh pemilik CV Hikmah kepada nasabah bukan milik sendiri. Adapun penyelesaian wanprestasi jual beli di CV ix Hikmah Kabupaten Lampung Selatan dengan para nasabah dilakukan secara nonlitigasi yang dinegosiasi antara kedua belah pihak dengan dua opsi, yaitu menunggu keputusan antara pemilik lahan dan pemilik CV Hikmah, dan yang kedua yaitu mengembalikan uang nasabah, sesuai dengan angsuran yang telah dibayar, penyelesaian permasalahan jual beli secara musyawarah atau secara perdamaian tersebut tentunya telah sesuai dengan penyelesaian secara hukum Islam. Kata kunci: jual beli, wanprestasi, hukum ekonomi syariah x ABSTRACT This research is motivated by the practice of buying and selling land at CV Hikmah, South Lampung Regency. In the practice of buying and selling, the owner of CV Hikmah buys land from a land owner with a land area of ±3 Ha (Hectares) in the amount of Rp. 296,000,000 (two hundred and ninety-six million rupiah) with a credit sale and purchase system, the owner of CV Hikmah has evidence in the form of a sale and purchase agreement and receipt of repayment, which has been signed by both parties but the land owner feels that the owner of CV Hikmah reneged on the agreement has been agreed upon by both parties, because the owner of CV Hikmah did not pay off the land price agreement to the land owner resulting in default, then, the owner of CV Hikmah has traded the land to his customers with a credit buying and selling system with a total of 71 plots of land from the area land ± 3 Ha (Hectares), causing losses to buyers of land plots in CV Hikmah, South Lampung Regency. Based on this description, the author is interested in analyzing Islamic law, because there is a sale and purchase of default. The problems of this research include: 1) What is the review of Islamic law in Indonesia regarding the practice of buying and selling land at CV Hikmah, South Lampung Regency? 2) How to resolve the default practice of buying and selling land in CV. Lessons from South Lampung Regency? The method used is qualitative. Including field research, this research also uses literature. Research results: the practice of buying and selling between the owner of CV Hikmah and the land owner is carried out with a sale and purchase agreement, in practice the land owner feels that the owner of CV Hikmah does not pay the price according to the agreement sale and purchase (default), so that the land owner feels disadvantaged and asks the owner of CV Hikmah not to make a sale and purchase transaction on the land, in this case CV Hikmah's customers have been harmed by the owner of CV Hikmah because the customers have bought the land with a selling system buying credit, in Islamic law if the conditions and pillars are not met then the sale and purchase is canceled because the object of goods (land) that has been sold by the owner of CV Hikmah to the customer is not his own. The settlement of non-litigation sale and purchase defaults at CV Hikmah in South Lampung Regency with customers was carried out in a non-litigation manner which was negotiated between the two parties with two options, namely waiting xi for a decision between the land owner and the owner of CV Hikmah, and the second is returning the customer's money, in accordance with the installments that have been paid, the settlement of buying and selling problems by deliberation or peace is of course in accordance with settlements according to Islamic law.
