ABSTRAK Perkembangan transaksi baik dari segi bentuk, jenis, maupun metodenya pada era globalisasi ini berkembang sangat cepat. Persoalan-persoalan hukum transaksi (muamalah) dalam berbagai aspek yang dulunya tidak pernah terbayangkan muncul, misalnya transaksi jual beli berbasis NFT. NFT sebenarnya dilatarbelakangi sebuah karya seni menjadi aset investasi yang bersifat hiburan. Dimana seseorang menjual hasil karya NFT melalui platform opensea.Tujuan penelitian ini untuk mengetahui mekanisme penjualan karya/kreasi digital berbasis Non Fungible Token (NFT) pada Platform OpenSea. Serta untuk memahami tinjauan hukum ekonomi syariah terhadap mekanisme penjualan karya/kreasi digital berbasis Non Fungible Token (NFT) pada Platform OpenSea. Penelitian ini termasuk penelitian kepustakaan (library research) yang menggunakan data sekunder yang terdiri dari tiga bahan hukum yaitu bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Penelitian ini bersifat deskriptif analisis. Metode pengumpulan data yang digunakan adalah studi literatur berupa buku-buku, tesis, majalah, jurnal atau literatur-literatur lainnya yang membahas dan mengulas tentang permasalahan penelitian. Data yang terkumpul dianalisis secara kualitatif. Berdasarkan hasil analisis tersebut dapat dikemukakan bahwa mekanisme penjualan NFT di OpenSea yaitu harus memiliki saldo cryptocurrency atau uang Ethereum melalui dompet MetaMask, memiliki akun, memiliki karya NFT, tentukan harga, berapa lama durasi NFT akan dijual terakhir unggah NFT di OpenSea dan mekanisme penjualan NFT di OpenSea dalam tinjauan hukum ekonomi syariah, belum terpenuhi rukun jual beli, dikarenakan pada nilai atau alat tukarnya (saman) mengandung unsur gharar dan dharar di dalam transaksinya. Namun perlu diakui bahwa dunia terus berkembang dan teknologi semakin canggih tidak menutup kemungkinan NFT suatu saat akan dilegalkan. Tentunya dengan persyaratan-persyaratan yang menghilangkan gharar dan dharar. This research includes library research using secondary data consisting of three legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials. This research is descriptive with analysis method. The data collection method used is literature studies in the form of books, theses, magazines, journals or literature others who discuss and review the research problems. Data collected were analysed qualitatively. Based on the results of the analysis it can be stated that the mechanism for selling NFT in OpenSea is to have crypto currency or Ethereum cash balance through a MetaMask wallet, have an account, have an NFT work, determine the price, how long will the NFT be sold, lastly upload NFT on Opensea and the mechanism for selling NFT in OpenSea in a review of sharia economic law, the pillars of buying and selling have not been fulfilled, because the value or medium of exchange (saman) contains gharar and dharar elements in the transaction. However, it must be admitted that the world is constantly developing and technology is increasingly sophisticated, it does not rule out the possibility that one day NFTS will be legalized.
