Abstract

ABSTRAK Masayarakat Desa Bumiharjo Kecamatan Batanghari Kabupaten Lampung Timur mayoritas penduduknya bekerja sebagai petani dan pekerja/buruh kasar. Buruh kasar dalam konteks penelitian ini adalah pekerjaan masyarakat Desa Bumi Harjo yang berkaitan dengan pengerjaan proyek-proyek kontruksi Pemerintah Daerah di bidang konstruksi. Dalam hal pembayaran upah (ujrah) dilakukan berdasarkan adat kebiasaan setempat. Dimana sejatinya penghasilan para pekerja dihitung harian, namun dalam pelaksanaan pembayaran upah tersebut dibayarkan pada tiap akhir tahun atau awal tahun depan (setelah selesai semua proyek-proyek konstruksi yang ada). Berdasarkan pra-riset, diketahui juga ada sekitar 11 (sebelas) pekerja yang sampai saat ini belum menerima upah (ujrah) tahun 2020. Adapun peneliti dalam hal ini melakukan penelitian dengan judul “Analisis Hukum Ekonomi Syari‟ah terhadap Penundaan Pembayaran Upah Buruh Kasar pada Proyek Pembangunan Pemerintah Daerah di Bidang Konstruksi (Studi Kasus Di Desa Bumi Harjo Kecamatan Batanghari Kabupaten Lampung Timur).” Melalui penelitian ini, peneliti ingin menganalisis tentang bagaimana praktik pembayaran upah (ujrah) pada para pekerja/buruh kasar pada proyek-proyek pembangunan Pemerintah Daerah di bidang konstruksi, sebab terjadinya praktik tersebut serta bagaimana tinjauan Hukum Ekonomi Syari‟ah terhadap praktik-praktik tersebut. Penelitian ini merupakan Penelitian Lapangan (Field Research) dan bersifat Deskriptif Kualitatif, artinya penelitian ini nantinya akan menghasilkan data deskriptif berupa kata-kata tertulis dari orang-orang dan perilaku yang diamati. Adapun Sumber Data yang peneliti pakai adalah sumber data primer dan sumber data sekunder yang peneliti peroleh dari para pihak yang terkait dalam penelitian serta dari buku-buku yang berkaitan dengan penelitian ini. Selanjutnya berdasarkan analisis data yang peneliti lakukan, diperoleh kesimpulan bahwa praktik pola pembayaran upah (ujrah) buruh kasar yang bekerja pada proyek-proyek pembangunan Pemerintah Daerah di bidang konstruksi studi kasus di Desa Bumi Harjo Kecamatan Batanghari Kabupaten Lampung Timur masuk kedalam kategori Urf‟ Fasid yang bertentangan Syari‟at Islam. In the case of payment of wages (ujrah) is carried out based on local customs. Where the actual income of the workers is calculated daily, but in the implementation of the payment of wages is paid at the end of each year or early next year (after completion of all existing construction projects). Based on pre-research, it is also known that there are around 11 (eleven) workers who have not yet received wages (ujrah) in 2020. The researchers in this case conducted a study entitled "Analysis of Sharia Economic Law on Delays in Payment of Wages for Rough Workers in Regional Government Development Projects in the Construction Sector (Case Study in Bumi Harjo Village, Batanghari District, East Lampung Regency)." Through this study, researchers want to analyze how the practice of paying wages (ujrah) to workers/unskilled laborers in local government development projects in the construction sector, the causes of these practices and how the Sharia Economic Law reviews these practices. This research is a field research and qualitative descriptive, meaning that this research will produce descriptive data in the form of written words from people and observed behavior. The data sources that the researcher uses are primary data sources and secondary data sources that the researchers obtained from the parties involved in the research and from books related to this research. Furthermore, based on the data analysis that the researchers carried out, it was concluded that the practice of the pattern of payment of wages (ujrah) for unskilled laborers who worked on local government development projects in the case study construction sector in Bumi Harjo Village, Batanghari District, East Lampung Regency was included in the Urf' Fasid category. contrary to Islamic Shari'ah.
