Abstract

ABSTRAK Poligami merupakan masalah klasik yang selalu aktual dan menarik didiskusikan. Terlepas dari pro dan kontra, faktanya hampir pada setiap ruang dan waktu masih banyak pelakunya. Hukum Islam dan Hukum Positif telah memberikan aturan tentang poligami agar poligami menjadi salah satu solusi bukan membuat masalah baru. Seorang suami yang ingin melakukan poligami harus memenuhi syarat-syarat yang sudah diatur dalam hukum dan undang- undangnya, di antaranya tidak lebih dari empat istri, mampu berlaku adil dan atas izin istri. Kota Bengkulu merupakan kota yang heterogen suku, agama, adat istiadat, status sosial dan profesi penduduknya, termasuk yang tinggi angka pelaku poligaminya. Dalam penelitian ini ada tiga rumusan masalah yang ingin diangkat, yaitu: 1) Apa motivasi pelaku poligami di Kota Bengkulu perspektif Hukum Islam dan Hukum Positif? 2) Bagaimana praktik kehidupan keluarga poligami di Kota Bengkulu? 3) Bagaimana wujud keadilan dalam keluarga poligami di Kota Bengkulu perspektif Hukum Islam dan Hukum Positif?. Tujuan penelitian ini adalah: 1) Ingin menganalisis motivasi pelaku poligami di Kota Bengkulu perspektif Hukum Islam dan Hukum Positif. 2) Ingin menganalisis praktik kehidupan keluarga poligami di Kota Bengkulu. 3) Ingin menganalisis wujud keadilan dalam keluarga poligami di Kota Bengkulu perspektif Hukum Islam dan Hukum Positif. Penelitian ini adalah penelitian lapangan (field research) yang bersifat deskriptif kualitatif. Data primer bersumber dari wawancara dengan responden. Adapun data sekunder bersumber dari buku-buku fikih klasik dan kontemporer, buku-buku hukum, jurnal penelitian, dan dokumen-dokumen yang berkaitan dengan tema penelitian. Dalam menganalisis data digunakan teori maslahat dan sadd al-dzari’ah, serta beberapa pendekatan seperti yuridis, psikologis, sosiologis dan ekonomi. Adapun temuan dalam penelitian ini adalah: Pertama, motivasi pelaku poligami di Kota Bengkulu perspektif Hukum Islam semuanya sudah sesuai dan tidak menyalahi sedangkan dalam perspektif Hukum Positif terdapat motivasi di luar aturan yang telah ditetapkan seperti ingin memiliki anak berjenis kelamin perempuan. Kedua, praktik kehidupan keluarga poligami di Kota Bengkulu berjalan secara normal dan tergolong sebagai rumah tangga yang cukup harmonis. Ketiga, wujud keadilan dalam keluarga poligami di Kota Bengkulu seperti adil dalam memberi giliran bermalam, tempat tinggal, dan nafkah bulanan untuk kebutuhan makan sehari-hari dan pakaian dalam perspektif Hukum Islam dan Hukum Positif semuanya sudah terpenuhi. Regardless of the pros and cons, the fact is that in almost every space and time there are still many perpetrators. Islamic Law and Positive Law have provided rules regarding polygamy, in order to polygamy is being a solution and not make a problem. A husband who wants to practice polygamy must fulfill the conditions stipulated in the law and the constitution, including no more than four wives, able to act fairly and with the wife's permission. Bengkulu City is a heterogeneous city of ethnicity, religion, customs, social status and profession of its population, including the high number of polygamists. In this research there are three formulations of the problem to be raised, there are: 1) What is the motivation of polygamists in Bengkulu City from the perspective of Islamic Law and Positive Law? 2) How is the practice of polygamy’s family life in Bengkulu City? 3) What is the form of justice in polygamy’s family in Bengkulu City from the perspective of Islamic Law and Positive Law?. The purpose of this research are: 1) Want to analyze the motivation of polygamists in Bengkulu City from the perspective of Islamic Law and Positive Law. 2) Want to analyze the practice of polygamy’s family life in Bengkulu City. 3) Want to analyze the form of justice in polygamy’s life in Bengkulu City from the perspective of Islamic Law and Positive Law. This research is a descriptive qualitative field research. Primary data sourced from interviews with respondents. The secondary data comes from classical and contemporary fiqh books, law books, research journals, and documents related to the research theme. In analyzing the data used the theory of maslahat and sadd al-dzari'ah, as well as several approaches such as juridical, psychological, sociological and economic. The results in this study are: First, the motivation of polygamists in Bengkulu City in the perspective of Islamic law is all appropriate and does not violate, while in the perspective of Positive Law there are motivations outside the rules that have been set, such as wanting to have a female child. Second, the practice of polygamous family life in Bengkulu City runs normally and is classified as a fairly harmonious household. Third, the form of justice in polygamous families in Bengkulu City, such as being fair in providing overnight shifts, housing, and monthly living for daily food and clothing needs in the perspective of Islamic Law and Positive Law have all been fulfilled.
